My ignorance speaking here, but I always thought a plea bargain had to be offered by the Prosecution. ?

One thing most people, often forget is. Their is a reason why, a lawyer becomes a Prosecutor. And not a defense attorney. You do not have to be a good lawyer to be a Prosecutor.

You will starve if your not a good defense lawyer.

If your not a very good lawyer your a prosecutor, and you would much rather, sell the victims out. Plea bargaining, then making the criminal pay for their crimes. Then to prove why your a prosecuting attorney.

A good defense attorney, is going to bleed the criminal for everything they can. Just as RN attorney did, He milked, the state out of every dollar, he could, with his motions and delays. Until he seen he could not go down, that path any longer. Now he had to convinced, RN to take a deal and he can still bill the state, representing her as a witness.

Defense attorney do not care if someone is guilty, it is squeezing the most money possible. Out of their clients. (Or the State with the 4W's} Any of the 4W's gets a better deal then the others. Will make that legal team a lot more money down the road.

The state will pay more to the defense teams, then the Prosecuting team. If you was one of the defense Lawyers, and could drag this out a few years. While billing the state for 1000's of hours. Why would you want to settle it?

But the prosecutor wants it closed. So they will offer a deal.

And know one will care about any of these families when the money stops coming in.

@rsd1200 - you mentioned that these are DP cases - I just skimmed thru their dockets (actually just JW, since you mentioned him). I didn't find anywhere that it said it was a death penalty case.... when did DA announce that? Thanks - just want to keep my notes straight!

The very firs trials all of the 4 accused Wagners where a signed Death Penally Attorneys to defend them, that is what makes us think that this is death penalty cases,

2001 BW and AW Road Rage Incident with a .40 Caliber Glock Gun allegedly found in AW purse after BW had been brandishing weapon towards teenager and father. BW pled no contest and served no jail time/suspended sentence. AW charges dropped. BW's attorney now represents AW's mother in this case.

2002 BW and AW both convicted of Receiving Stolen Property in Ross County. Evidence seized in the case included “various items belonging to Kohl’s, Ollie’s, Wal-Mart, Sam’s Club, Super K-Mart, Hobby Lobby, Sears, and Lowe’s.” Each were sentenced to 1 year community control and restitution to Sears and Lowes.

One thing most people, often forget is. Their is a reason why, a lawyer becomes a Prosecutor. And not a defense attorney. You do not have to be a good lawyer to be a Prosecutor.

If your not a very good lawyer your a prosecutor, and you would much rather, sell the victims out. Plea bargaining, then making the criminal pay for their crimes. Then to prove why your a prosecuting attorney.

A good defense attorney, is going to bleed the criminal for everything they can. Just as RN attorney did, He milked, the state out of every dollar, he could, with his motions and delays. Until he seen he could not go down, that path any longer. Now he had to convinced, RN to take a deal and he can still bill the state, representing her as a witness.

Defense attorney do not care if someone is guilty, it is squeezing the most money possible. Out of their clients. (Or the State with the 4W's} Any of the 4W's gets a better deal then the others. Will make that legal team a lot more money down the road.

The state will pay more to the defense teams, then the Prosecuting team. If you was one of the defense Lawyers, and could drag this out a few years. While billing the state for 1000's of hours. Why would you want to settle it?

But the prosecutor wants it closed. So they will offer a deal.

And know one will care about any of these families when the money stops coming in.

Thank you for your comments; however, RN was not indigent and Gerlach is not being paid by the State. Only the 4 Wagners have court-appointed attorneys. This info can be found on the PC Common Pleas website.

5th photo. You can see glare on the mirror and it's a very up close shot that doesn't look like anyone else took it. Plus the photo is inside a room consistent to where a mirror would be as opposed to being outside or being in the middle of a room etc...

I am going to respectfully disagree with you about the reason people become both State Prosecutors and Public Defenders. State Prosecutors and Public Defenders don't make top money and work long hours, so why do they do it? IMO, they do it for the same reasons people become Social Workers. It is the chance to make a difference in this world.

There is a vast difference between attorneys who choose to become Public Defenders and those that choose to become Ambulance Chasers.

PD defend the indigent, those that can't afford top lawyers to argue for their basic Constitutional Rights. The PD tries and researches possible defenses they do their best and then it's on to the next case, regardless of the financial losses or gains. They don't have a dog in the fight or a choice in the next case they are assigned.

On the other hand an ambulance chaser attorney will only take cases they know they can negotiate for a big $$$ settlement. Then they walk away with a huge % $ of the win, which is usually the greatest part of the settlement.

RN did not choose to declare indigence for her case. Therefore, she declined a state appointed PD.

We have not idea of who is actually paying Frank Gerlach, but we do know it was not the state....

The state of Ohio hasn't paid a penny for her defense.
