I recall discussion about that at the time - that DS' story didn't sound right - and later on it came out he was having an affair.
His story (that he was to spend the night at Kenny's to work with him in the morning) was to cover up his not sleeping at home with his wife the night before.
JMO - I don't have any links - MOO.

I remember that coming up, also. Made me wonder what else was not as portrayed by him. I have always thought he was there twice that day. The second time with someone to prove he was there and any evidence of him would be expected. Only my opinion...

I felt the Defenses best chance for a acquittal. Was to have all the defense teams demand speedy trials. So the State would have had to try them all in a short amount of time. Just overload the court system. JMO
I agree and have thought that too. They should’ve rushed them but instead they are doing the opposite

In my opinion the reason none of the W4 "rushed it" is because of the death penalty. Too much at stake IMO

The reason for not demanding speedy trials can best be attributed to lack of discovery evidence, at least in regards to GW4.

GW4 had his trial scheduled for:

At the July 24, 2019 pre-trial hearing the motion to waive speedy trial was granted:

Judge Deering:
Now let's consider the matter of the continuance of the jury trial. Do you wish to address that council?

Attorney:

We did file a motion to continue trial ... the biggest issue is lack of discovery.
We understand there will be more discovery forthcoming. In light of that, in time to prepare for trial we'd ask to continue that. In addition with that request we have an executed time waiver here as well.

Judge Deering:

You wish to approach with that?

GW4's attorney gives the waiver to the judge that GW4 signed, and the judge addresses Mr Wagner advising him about his US and Ohio Constitutional rights to speedy trial and asks him questions about it to make sure it's on record that this is what Mr. Wagner wants etc...

08/13/2019 JOURNAL ENTRY --

The Court finds that on July 22, 2019, the Defendant filed a "Motion To Continue Jury Trial," requesting that the jury trial previously scheduled in this action to commence on September 4, 2019, be continued. Counsel for the State of Ohio has no objection to the continuance of the jury trial in this action. After having conferred with his attorneys the Defendant, on the record in open court, orally waived his right to a speedy trial, and the Defendant also executed a written "Waiver of Speedy Trial."

The Court grants said motion; and it is hereby ORDERED that the Assignment Commissioner shall re-schedule the jury trial in this action for a date to be determined at a later time.

Felonies
  • Preliminary Hearing, if in Jail: 10 Days
  • Preliminary Hearing, if not in Jail: 15 Days
  • Trial: 270 Days
Misdemeanors
  • Minor Misdemeanor: 30 Days
  • 4th or 3rd Degree Misdemeanor: 45 Days
  • Unclassified Misdemeanor: 45 Days
  • 2nd or 1st Degree Misdemeanor: 90 Days
Time can be waived by a time waiver signed and placed in the record.

Time can be tolled (or stopped from accumulating) based upon many small events, such as a demand for discovery, the filing of a motion, or requesting a pre-trial.

WHAT IS JAIL TIME CREDIT?

Each day during which the accused is held in jail in lieu of being out on bail must be counted as 3 days for purposes of speedy trial. R.C. 2945.71(E).

It is important to be aware, this 3 for 1 is only for the counting of speedy trial. It has no effect on any calculation of time served.

Yeppers, Tricia provides us with a great place to basically moan and groan and sometimes even discuss all these cases. :D LOL There is no other place I'd rather be than WS's, what a voice for the missing and murdered. It matters!!

Yes getting word out about missing persons!

And there are so many aspects you learn about cases that on your own you don't see. Like someone posting local news that others don't see or various types of on-line records or I have had posters send me documents like a police report or old mug shot or SM that I would otherwise not see etc....Lot's of things. I could write a long list.

And when trials and hearings are coming up posters have reminded me about them or recap them when I miss them. When the 4 Wagner trials come up we need a place to discuss them.

I heard from Scales of Justice (youtube site that posts court videos on the Wagners) that the trials will be streamed. I don't know where Scales of Justice gets their information so I don't know if this is confirmed or not. So I have no idea if the Wagner trials will be live streamed. I sure hope so! If not, there will be that much more to find out about.

Yah...every time we keep hearing about the COORDINATING DISCOVERY ATTORNEY.

Recently in JW's and BW's hearings it came up, plus it came up in one or two earlier hearings -- with Deering saying it costs $80,000+ --
and Deering saying he will make a ruling on it.....yawn.....Death penalty trials, too time consuming, this is a con, meaning negative point of them.

In Ohio, if juries recommend capital punishment, judges impose the sentence. Ohio judges can reject death sentences but can’t impose them if juries don’t recommend them.

Recently in JW's and BW's hearings it came up, plus it came up in one or two earlier hearings -- with Deering saying it costs $80,000+ --
and Deering saying he will make a ruling on it.....yawn.....Death penalty trials, too time consuming, this is a con, meaning negative point of them.

I can honestly say, my stop is coming up and I'm about to get off this long, black train. I will pray forever for justice for the Rhodens and Hannah Gilley, and for healing and success for the children involved, and next for all the innocent lives touched by this awful, awful tragedy. People like Charlie Reader, who has had his whole life ruined over this. All because of 4 murdering lowdown monsters who had to have it their way. May they die more and more everyday, knowing what they have done, and may time take its toll fast and vicious on them.

I hope Deering rules NO on the coordinator, because all I've read is how they help the Defense set the Accused free. BS, NO!

Loomis I understand the frustration. We may not agree on this, which is no foul and nothing personal, just different points of view, but I feel Reader made his own bad choices which have led to his life being turned upside down.
Hate to see you go, at the same I understand the frustration.

I don't know how others feel, but I would support having to pay a minimal fee for say a yearly membership but that's entirely up to Tricia. JMO. Something to consider I suppose. Again, MOO.

Agree to disagree, Tiff. But I will tell you one thing. How can any of us put ourselves in his shoes and say what would've come of our lives after seeing THAT? I don't know what I would have done, but I can say from my heart, Charlie was stronger than I could ever be. At least he turned it all inward and didn't hurt anyone but himself and his family. He did not seek revenge, even knowing what he knew. He loved those kids with all his heart and stood up for them in court against Rosenberger when not A ONE of their own family even showed up. So blast him, come one, come all...throw your stones. And sleep peacefully that you have done the right thing. Only Charlie could then and still can, IMO, know that he did all he could, the best he could, under the circumstances.
