thats exactly what g4s lawyer was going for chinese whispers. its a deflection and obfuscation tactic. come up with a bold claim which doesnt change guilt under the law, but serves as a spark to erode the case and distance the defendant from the most grusome evil elements of the crime.
legally speaking g4 is guilty of all 22 charges under the conspiracy statute. but once you make this debate about a singular irrelevant(if g4 shot a bullet which killed) issue it can sway the jury thru confusion or emotion.

look at the gloves in OJ case. they did not prove innocence nor was it a scientifcly sound premise. but it swirled up enough whispers that it became the center of the defense. if the gloves dont fit you must aquit! i guess a big difference with georges lawyer is that seems to concede his client was present at murder scenes but under mitigating circumstances(yuk).this is 8 murders so hopefully the issue is dead in the water in juries mind.
. i like visiting the scenes people will follow this much better once they have their barrings. too many facts details posters and slideshows can be disorientating if you dont have a reference in your minds eye. now once the jury sees the crime scene photos, hears of the detailed planning they will understand all the pieces the wagner crime family put together in order to snuff out 8 lives and ruiin countless more.

True, the motion is probably an attempt to distract the jurors after they've been to the crime scenes and before they visit the Rhodens' trailers and KR's camper tomorrow. That will be a powerful tour and Nash & Parker want to distract from it as much as possible.

The complexity of the locations, crime scenes, evidence, etc. will make it hard for jurors to buy into any "red herring" theories. It was a well planned, complicated, expertly executed massacre.

Forgive me for sounding dumb: If the Defense wants EW to testify, wouldn't they have to to know where to send/deliver a subpoena?
The court can handle that for them.

If the jurors won't know about it, then maybe the defense is just doing it in hopes it gets a mistrial or grounds for appeal?

In the Twitter post above from Angenette Levy, there's a photo at the intersection of UHR and OH 722 where the bus stopped to show to jurors. I couldn't copy her photo from Twitter, but here's a photo of it from Google Maps. It's the brown house surrounded by trees in the center of the snap.

Not sure what it is or how its relevant to the case, but it's located at a key intersection where the Wagners would have traveled between the murder scenes on UHR and their staging area on Bethel Hill Rd, also Flying W Farms. Maybe this house had a security cam that captured video of their vehicle? We'll find out.

GW4's attorneys are filing another motion demanding the prosecution tell them where Jake's wife, Elizabeth Wagner is located. The Judge refused the same kind of motion on August 5.


Nash & Parker are up to 109 Motions now. Imagine how many "objections" they'll file during the trial.

These stalker motions demonstrate exactly why GW4's attorneys should NOT have access to this witness's location.
I thought this was settled by another judge?

Here's the latest from the Cincinnati Enquirer. Judge Deering and his court reporter went along for the jury view tour


Deering said the tour, called a “jury view,” will help jurors better understand the evidence they will see or hear during a trial that is expected to last six to eight weeks.

But he reminded jurors that they can only judge Wagner’s guilt or lack of guilt by evidence the state of Ohio presents against him.

“What you observe outside the courtroom is not evidence,” he said.

With that, the bus took to narrow, windy country roads for sites in or near Pike County. Joining the jurors were lawyers for both sides, other court staff and about a half dozen armed members of the Pike County Sheriff's Office and the Ohio Bureau of Criminal Investigations.

Only the court bailiff provided the information at each stop.

First 2 stops were at CR1 and Frankie's trailer sites on UHR (Union Hill Rd)

Third stop was at the brown house (linked above) at the intersection of UHR and OH 722


Fourth stop was at OH 722 and Bull Hill Rd. the location of Harmon Cemetery and Harmon Salt Creek Church




Fifth stop was at Hwy 312 (Left Fork Rd) and Hwy 22 (Camp Creek Rd) - there was a white 2 story barn and a tractor - this is also about where Kenneth Rhoden's camper was located



The 6th Stop was at Dana's home on Union Hill Rd

The article states the jurors only got out and walked around at the first 2 stops - the sites of CR1's and Frankie's trailers. Technically it was only 1 stop as they walked from Chris's trailer site to Frankie's. News media was not allowed within 150 ft of the jurors. No talking to them, etc.

I hope this makes sense. I'll try to put it into map form later.

I think the tour of the crime scenes is to show that it was possible for them to commit all these crimes during that one night and do so unnoticed. Since there were 4 crime scenes and 8 people killed, maybe it was just needed to really give an idea of how much planning when into it, how coordinated it was in case the defense tries to say how could anyone do all this?

I am just guessing here, but I'd say at least opening arguments will be done Tuesday, but the subpoenas are dated for the 6th so I think some witnesses could be called that day if opening statements are short.
You make a great point here. When news of these murders came out that morning, and how many people were killed, how many dwellings were targeted.....one of my first thoughts was this was not something one person could pull off solo. My thought at the time was it had to be more than one person. With the two trailers so close in proximity to each other, I thought at the time that it would be difficult for two people to do this. I think, this tour will go to show it was just not GW3 and JW accomplishing this. They had assistance.

I don't immediately recognize the significance of stops # 3, 4 and 5.

Do you think any of these might have been look out locations? Maybe to see when Dana Rhoden was traveling home from work that night?

Otherwise, might have been the sites of home video cameras that captured the two trucks the W4 used that night.

I looked closer on the map and #5 was the site of Kenneth Rhoden's camper on Left Fork Rd, or near to it anyway.

The other two sites are unfamiliar. Possibly look out or meet up sites, possibly where security cameras caught video of them driving by that night. Also possible that evidence was found there. Just guessing.

If you look at them on Google Maps, they're rather remote locations, some on gravel roads. It would have been dark that night and I assume there wouldn't have been much traffic, especially at that hour.

I like the visit to the locations pre trial or pre witness. Itll help put the evidence given into aittle better perspective.

I like the makeup of the jury.

I dont get why the need for JWs ex to be doxxed either. Anything she would have to say is all post murders. Can she really provide any more evidence than what AW and JW has provided?

To me, this isnt a complicated trial. The prosecutors have the evidence pre and post confessions from 2 of the 4 Ws. Im sure AC will keep it clean and tidy. Dont over complicate the evidence.

2 months seems like a long time but im not a prosecutor so...JMO

It's possible. If they're wanting to give the jurors a narrative of what happened that night, who, where and when, they might make these visits according to the timeline. According to the Law & Crime video upthread, they're going to Fred Wagner's farm and the Pike County Impound Lot to see the trailers and camper. Assume they will also go to the former Wagner farm on Peterson Rd.

Interesting, also, that there were no cell phone signals or internet access on those back roads. Good way to get around without anyone being able to track your electronic data footprint

As I recall, some people here (and probably elsewhere) speculated that she may have been the one who overheard the Wagners making plans to break out of jail, kill the governor and BCI agents, etc. GW4 was part of that discussion and, according to Angela Canepa, made some very violent threats. If so, she might be a key witness in GW4's trial, someone who can give first hand accounts of his threats, obstruction and discussion of his participation in the murders. The defense would like to do anything that could help them discredit her as a witness for the state.

JMO, just a guess.

If JW and AW's proffer's implicate GW4 than I can see them not needing JW's ex. Like you said, don't drag someone onto the stand if not needed. Perhaps she WOULD be needed to affirm GW4 narrative IF it's in the proffer. IDK JMO

I believe she is already a prosecution witness. Would they also need her address then? There has to be a way to get a witness into court without disclosing the location for someone that is in fear for their life and given this case, I'd say she has a right to be afraid.
