I wonder who is sick or if the defense is using illness as a delay.
I believe if the Court has granted this delay, there is truly someone that is ill.

Now in this ensuing week of downtime, who knows what could happen?

According to the prosecution’s theory, the conspiracy started in December 2015 when Angela Wagner found a Facebook message between Hanna May Rhoden and George Wagner’s former mother-in-law, Patricia Sexton, in which they discussed the Wagners’ efforts to get Hanna May to sign over custody of the daughter she shared with Jake.

Testimony at a motion hearing in August 2020 revealed that Hanna May responded to Sexton: “They’ll have to kill me first.” Special prosecutor Angie Canepa stated at a May 2022 motion hearing that Angela Wagner has admitted to hacking into Hanna May Rhoden’s social media accounts, and the accounts of others, to monitor their communications to gather damaging information. Canepa has said Angela Wagner showed the message to Jake and the murder plot unfolded from there.

The message between Sexton and Hanna May Rhoden is important to the state’s case because it establishes a timeline for the murder conspiracy and shows the Wagners’ alleged “obsession with control and custody of children.” It is expected to be used at trial as evidence.

Sexton is Tabitha Claytor’s mother. Claytor is George Wagner’s ex-wife and she told investigators that the Wagners pressured her to sign over custody of the son she shared with George, according to prior testimony.

Canepa stated during a hearing in May that Claytor fled the home fearing for her life after the Wagners threatened to shoot her. Canepa said Claytor told investigators that she signed the documents giving up custody of her son after being told the arrangement would be temporary. Canepa said Claytor was not allowed to visit her son as the Wagners had promised.

If it is one of the jurors couldn't they put an alternate in place. I'm just naturally cynical with all of the delays. Maybe it is one of the attorneys or GW4. I can't really believe he thinks he will be acquitted or receive a lesser sentence than AW at 30 years

IMO, illness is most likely attributed to the defendant.

GW4 is currently housed at the Scioto County Jail. According to the Scioto County, OH, COVID Tracker, the community risk on 9/5/22 is rated as "HIGH."

The trial is now scheduled to start on Sept. 12. According to court documents, the delay is due to the illness of the special prosecutor in this case.

Nevermind, I found it. The new formatting of the PC Court View site is confusing.

Let's see if this works. When you view the docket, you used to scroll to the bottom for the latest entry. Now you have to
look in the lower right corner for arrows to go to the next page. The next entry shows the Judge granting defense Motion 96, to prevent the prosecution from using evidence of Chris Sr and Billy Wagner getting in a big fight a couple weeks before the murders. It's considered hearsay because all those who witnessed it are deceased with the exception of the killers.

The judge also denied the defense's motion to not allow the state to use Hannah's text message stating "they will have to kill me first" re giving up custody of her daughter. The text message is still admissible evidence.

Can you remind us others who’ve used their Site less frequently, the best way to search for them to get to these relevant case(s) (esp since some of have several traffic and other smaller cases that come up in the search results)? Every time I try using the case # on the search form I get no results.

This could also help remind us all the best way, since you clearly know better than I on how best to find this specific case on their site. Thank you in advance.

Thinking about how the crimes happened on the eve of trial one thing I have pondered is what if GR was not at home with CRsnr when the Wagners arrived that night, could explain why CRsnr was said to have been dead longer than the others. If they arrived murdered CR snr then went and murdered the others GR may have arrived at CRsnr home when the Wagners went back to collect the cameras and phones and whatever else they decided to take, then they killed GR.

Just my ponderings on why CRsnr could have been dead longer than others, also maybe they knew GR should have been their so one or more of them stayed at CRsnr to wait for him, this then leaves JW to go and murder his 5 victims whilst BW and GW stayed waiting for GR,

The sequence of events is one of the things I really want to find out, as for years (before we were told about drug deal ruse) I was certain they went to Danas house first, then to Frankies then to CRsnr, and my reasoning was HR was the main target so to me the logic would have been ensure you killed the principal target, then go to Frankies as he may have been seen as less of a threat than CRsnr, then after killing CRsnr to to KR, after drug ruse story it now seems logical CRsnr was their first victim


I've always felt Gary showed up later, possibly even at Kenny's first. Ive not seen proof if the blue car towed from Kenney's was his personal car or not? Possibly Gary's? Its my opinion Gary would have a lot connections in Kentucky, if we are to believe Chris Sr bought into the drug deal ruse.I can see Gary possibly stopping by Kenny's first, but his car not starting. Then if Kenny takes Gary to Chris Srs, the Wagner`s would most likely think Kenny would know. This is my opinion of a possibility only.

Sad it is delayed but Im sure it is legit since it is AC. I fly back to the usa on the 12th. Perhaps i can drop in on the trial. Does anyone know the protocol for entry?

I hope AC feels better real soon and everyone else can stay healthy! Good thing I checked in here or I would have been wondering what was going on. At least I won't miss any of the opening trial day today and can get something done the rest of the week! ;)

O/T -- I'm recalling the Rhoden family matriarch doing her best to attend court over the years. Does anybody know if she's still living?
She is. I'm sure she's gonna be front and center for the trial too

I don't understand judge D's garbage about not allowing the trial to be televised when Ohio SC states in black and white they can be. I'm hoping after he again shuts them down again today its appealed all the way to OSC if needed.

JOURNAL ENTRY
The Court is informed that on September 2, 2022, at approximately 3:50 p.m. the Clerk of Courts received, via facsimile transmission, a motion entitled "MOTION FOR MEDIA ACCESS" filed on behalf of The Cincinnati Enquirer, Sinclair Broadcasting, WLW-TV, WCPO, WXIX, The Scioto Valley Guardian, Court TV, and Law and Crime TV ("movants"), asking the Court "for an order permitting the recording of the testimony of Jake and Angela Wagner, for an order permitting the audio recording of any witness who opts out of being video recorded and for the placement of a second camera to record the lawyers interrogating witnesses." The movants further filed a "MEMORANDUM IN SUPPORT" of their motion.
As counsel is aware, the Court has permitted media access in this case, approving the location of a video camera and microphone in the courtroom atop a book case, approximately 8 feet from the floor, beside the courtroom speaker, where view can be had of the Defendant, defense counsel, the prosecuting attorney, both special prosecuting attorneys, the witness chair, the bench, the judge, the court reporter, and courtroom monitors. The camera is so positioned that it is behind the jurors and the alternate jurors and there is virtually no chance that the jurors will be unintentionally videoed or that the camera will present a distraction to the jurors. The Court has also permitted the positioning of a second microphone for the media near the witness chair. Further, a number of seats are reserved in the courtroom for members of the media.
It is hereby ordered that the State of Ohio and the Defendant shall each serve and file a response to the movants' "MOTION FOR MEDIA ACCESS" on or before Thursday, September 8, 2022, at 4:00 o'clock p.m., stating the position of each such party concerning the requests of the movants' "MOTION FOR MEDIA ACCESS" and including an argument in support of each such party's position. Timely filing of the parties' responses with the Clerk of Courts by facsimile transmission (740-947-1729) or by email shall be permitted.
Non-oral hearing is scheduled on the "MOTION FOR MEDIA ACCESS" for Friday, September 9, 2022, at 8:30 o'clock a.m.
