Ok girl, help me with this.
After reading hundreds of pages regarding the benefits of joint or individual trials. My understanding is the 4 can be tried together because the charges overlap. And, severed trials are often the result of a co-defendant confessing or offering info that implicates the other.
Do you think this is the reason it’s predetermined to have separate trials? Because someone anticipates a confession?

Common Problems With Co-Defendant Cases | Tallahassee

I read this faster than the W’s packed for AK, it’s quite interesting.

Baha! That last line!

I think that will be it. I don't see a way to try them together. The speedy trial part, AW's paperwork did not have a date inserted for that portion. Idk if that's relevant or not, just remembering back. If she has an open date though, would she go last? Again, IANAL.

Also, let's say G4, rolls on them all and is part of a Co-Defendant case, he can, in court, decide to apply is Fifth Amendment rights, and not speak a word. If he does, then the other four lose their Sixth Amendment Right to be confronted by him, and his testimony. Screws the entire case up.

Sixth Amendment;
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

First hand, and very confidential

You’re lucky to have such sources.
I have 7 LE guys in my immediate family. Some high ranking. They wouldn’t tell anyone what they had for dinner let alone discuss intricate parts of an investigation. They’d all take a bullet to the brain, first.

Yup! I had to read the info repeatedly to understand, lol. Most confusing.
I expect no more than two head to trial.
They may be all ballsy now but once their lawyer tells them “son, it ain’t lookin good, a jury ain’t gonna like this. I wanna save YOUR life, you’re a young man, blah blah blah”, I expect mood changes.

Cool. You can tell us, we won’t tell anyone.
My post was to give some insight on how LE knows so many details. I won’t say anymore. Done posting

I’m not connected to LE or to this case. However, I have knowledge of things that have transpired.

I have seen no proof the JW's new girlfriend/fiancée/wife ever really existed. In the short time they were in Alaska, I don't see how she could have known him well enough that she would have gotten engaged to him. I'm not sure he had time to meet someone...
I agree, we haven't seen a proof. However anything is possible.

Somebody mentioned CW. I got curious and read a few articles about him. One of them is about the outpouring of love letters from women who are attracted to notorious criminals

OT, but a good laugh. I was in Indy the other day, met a guy, we exchanged numbers. He just called. I said “hi John”, he said “call me JD, everyone does.”

Uhm, nope. I can’t, at this point, begin a relationship that requires the use of initials. I’d lose my mind.

It’s prepostorous to think AW thought the boys would be happy living on an icy peninsula with their parents and two kids. How long might that have worked?

True. I’ll never go so far as to consider him intelligent.
I think there’s some type of deficiency going on....not sure what. Of course, with AW, it didn’t matter, she compensated for him.

I'm not sure what was meant by the 7th grade education reference, but maybe reading level is part of it?

If so I think the guy may be pretty average. This article discusses reading levels of many college freshman.

Back to biz!

Question:

Do you expect trials or pleading down?

I’m confident two will plead before all is said and done.

Yes, I think those attorneys in the podcast linked a couple pages back were discussing this problem. Makes it very hard on defense attorneys, limits what they can say. I have to go back and listen to it again. It was packed full of a lot of good information about what to expect.

It's worth considering. I noticed the timing, too, when first reading the indictments but set it aside. The odd thing is, if your theory is accurate, why then would LE arrest JM, but not the Wagners? Surely LE would have known the Wags had removed/dismantled any bugs that LE had placed on their cars, etc. IIRC, the assumption at the time was that JW had a bug on his truck, too, but hadn't removed it, hence no arrest. Perhaps those indictments tell us otherwise.

They may have dismantled them and then fled to AK, not knowing how long the bugs were there. This was right when they took off. They'd been talking revenge on LE, what they'd do if caught. I think LE needed the physical evidence, too, and, they needed them separate, but caught all at once.

No calls, no letters, no one in the same holding facility. I think this had to be laid out very well. They also had two children to think of, and people who were near them. What if they decided to pull a shootout and go out as one family?

They bring JM in to see what he knows, the Ws think, hey, we are golden, they think it's JM!! ETA; Or, Oh Crap, they know about the phone calls!! They're already in AK too, which they probably thought would be like going into hiding, only it wasn't. I think that GW4 may not have come back with the others, either, and stayed up there til he had to come down about B's family court hearing around the end of October.

Yea, what is meant? I guess that grade 7 was his last completed year. Idk if he’s literate. I recall he expressed no or little interest in the paperwork his lawyers had during arraignment. Me? I would've been speed reading each page. Oh, I forgot, he was poised to avoid the camera so viewing the docs’ was impossible.

Alaska is more than an icy peninsula. I know that and I am not Alaskan.

I’m surprised 4 did return for a civil matter. the State wouldn’t have spent money to brink him back. They don’t have the manpower or the money. They would have just waited for him to show up someday.

The better half and I were on two separate juries, two different cases, we discussed NADA, ZIP, ZILCH, until after the cases were over, and we'd done our due. Then it was fair game. ;)
