This Thursday, January 24th at 11:00am is a Pre-Trial and Motion Hearing for Edward Jacob Wagner.

One Motion to be discussed Thursday will be the request that Jake appear without restraints. Also, a hearing on the Bill Of Particulars is expected which provides more information than the indictment.

From the prosecution Jake's attorneys have received

1.) The 911 calls
2.) 1,475 crime scene photos
3.) Diagrams of the scene showing ballistics
4.) Diagrams showing biological evidence
5.) Evidence logs
6.) 111 aerial photos
7.) Autopsy reports
8.) Autopsy X-Rays
9.) 761 Autopsy photos
10.) Recorded interviews with the Wagner family
11.) 5 interviews with Jake from May 13, 2016 to
.......May 21st, 2017.
12.) 23 photos of Rudger Rhoden at the hospital
........on April 22, 2016

Adds up to more than 2,000 pages of reports so far,
the Prosecution is still disclosing Case Materials.

That was the first batch from late December, IIRC. I'm guessing the 3 drives that GW3's attorney had at his hearing the other day are the latest batch of evidence files.

Thanks for the reminder about Jake's attorney's request that he not wear restraints in the courtroom. It seemed like a risky request back then and still does. The guy planned and helped carry out the brutal, gruesome murders of 8 families members, moved out of state and helped plot revenge against LE and escape plans if caught. Not a good risk for being unrestrained in that old courtroom. Wouldn't they need to bring a couple more guards into the courtroom if they took off JW's handcuffs?

Judge Deering ordered the Pike Co Sheriff's Office to review different kinds of restraint devices available to help him decide on the Motion.

I take that to mean that he will still have to wear restraints but they will be less noticeable or not noticeable to the Jurors.

I mean, IMO, LE waited for the moment/day when GW3 would be out of his home, away from his sons to arrest him.

If LE believed the Ws posed a potential threat to law enforcement, this is what they would do.

Previously in May 2017, LE went to the farm with a large force. The arrest of GW3 outside of his home last november is not coincidence.

It's consistent with the profile of the man. All JMO.

Why the W were not charged with inflicting injury or endangering children? If it is not part of the indictements why make these photos as evidence?

Is it possible, some kind of evidence was found on the child, mixed with the blood of the victims?

Very good point. I agree, you would think with these photos the Wags would at least be charged with child endangerment.

Now that you mention it I'm surprised they are not being charged. After all, the prosecution pretty much has thrown everything--- including the "kitchen sink" at them.

Yes. It probably means the child was not hurt but carried evidence. If it is so, it's interesting.
ETA: if I were the defense attorney, I would ask to remove these photos from the evidence.

I have to go along with DeWine at this point. Bizzare, just bizzare. And I will always think leaving those babies ALONE for 5+ hours is child neglect/endangerment.

Brently could have wandered off or burned down the house or got injured in some way. And
you don't leave an infant in an adult bed unattended.

They couldn't even be bothered putting them in their cribs, yet they "bothered" themselves to move Chris/Gary. (One or both were moved.)

They wan him in street clothes and unrestrained so he does not look like a criminal in court. He looks like everyone else. How many privileges do they think they are entitled to?

No. I think that the searches and the "laser focus" was around the time I centered on the W4's.

When the murders first occurred, I like a lot of people on here, thought an ex might be responsible. I actually thought it would be solved in a few hours with an ex down the road in a car with a self inflicted gunshot to the head.

But when Kenny was found my focus changed. I think we tossed around the ex theory for a while but Kenny had us puzzled.

Oh please, Alexa devices are dumb and most people wouldn’t even think of owning one (me included) ... much less a murder suspect owning one.

LE can bug you in multiple different ways

However it gives an example of how conversations could have been over heard. We don't know if the Alexa device was used/owned by any of the accused or not. It has been stated LE is aware of conversations between those accused, many of us are here to discuss the case and possibilities.

Welcome to Websleuths!!!!! I knew the W's were guilty long ago. It was Jake that gave it away for me. Listening to him and knowing he was an ex...it all just fit. I know it is a while until trial but I am going to say Jake was the driving force behind it all. He is the center. He wanted Hanna dead for leaving him and he manipulated his family into going along with it. I believe he used the Clarence R issue to suck them all in.

It is interesting to go back and read the first threads, my theory was so off. Not proud to admit it, but I thought it was drug related. Couldn't think of anything that would be behind this vicious crime, just that it was committed by ruthless, cold, hardened criminals. Mother, father, and their two sons? I'm still in shock.

A real person listening in vs. an actual wire tap IS A BIG DIFFERENCE.

Imagine in court. #1.) A witness comes on the stand to testify about overheard conversations after the murders.
#2.) OR actual recordings are played in court and we can here the defendants in their own words talking about revenge and escape.

I just think it's a big deal if the Wags were overheard on wiretaps or if a witness overheard them. I know from researching other cases that when the defendant 's own words are played in court, there is often a conviction. Your own words are almost impossible for your defense attorney to get around.

Would they have only bugged the one room, or did the bug only capture talk of revenge? Was there no talk about "the act(s)" committed? If so, why did they leave that out of the indictments? That would be very damning.

Why bug FW's home? The 4Ws weren't living there.

They had pieces parts of a silencer, that they'd found much earlier, from the former searches, but DeWine said the investigator's discovery of a homemade gun silencer in late October was a critical piece of evidence (@5:58) (but we have no searches of any properties, in the timelines, for the date it was discovered). If it's a human CI, they could have given up the silencer as a show of good faith (especially if they have a history, as many CIs do).

Folks have thought that the two families may have been into the drug business with one another. A CI that was trusted by the Ws, but was facing a sentence, would be a likely candidate for a CI, who could wear a wire (or place a bug).

It is interesting to go back and read the first threads, my theory was so off. Not proud to admit it, but I thought it was drug related. I was far off as well. In the very beginning I was 100% IMO that it was murder-suicide and KR did it. Then, the cousin found him and hid the weapon to cover it up. Then, after hearing how some relatives plans were changed that night, I thought that HR's baby was fathered by a close relatives bf and also wanted the baby. KR wasn't part of the plan to be killed, but had to be because he would know what was going on. I have never shared that particular theory until today.

Yes, one's own words are ALMOST impossible for your defense, UNLESS your highly compensated attorney stands up in court, and in an exuberant manner states, "Yes that is my client's voice, and she was present. But, my client is hard of hearing and she didn't know what everyone else was saying!"
Oh, don't act so shocked, (it surprised me) because you know he is going to use that excuse for everything she ever said or for every meeting she was present.
