What do they usually do on this site in these situations (for other murders)

Depends on how long it drags on. I'll find some examples. The other alternative is that the Mods create a new thread when the trial begins, but it would be the same as this - no place to organize evidence, photos, trial docs, etc.

Some older examples of sub forums for single criminal cases:

Rebecca Zahau Nalepa

Kyron Horman

West Memphis III

Subs like these above are difficult for the Mods to monitor, etc. so they don't create them as often as before. If we were to convince them to create one for us, we would have to manage it carefully and not have too many topics going, too many discussions where people might be posting things that violate rules, etc.

I hope they do. What do you all think?

My guess is that a civil suit will be filed on behalf of the children. I am sort of surprised that one hasn't been filed already.

Does anyone know if the State has filed the Discovery list for FW?

I just looked at the court records and I can't understand if they gave her lawyer the list or not. Would someone look and give me their opinion? Thanks

It is public information so I don't know why we couldn't obtain the list.

No. Even if they would, the 4 W's in custody for murder x 8 have nothing for the Rhoden's to get. Or are you thinking they could get a civil judgment by going after Frederika? That won't happen IMHO.

They should on behalf of the little ones. They deserve having life a little easier when it comes to growing up and college, etc...

Very interesting points. As you, I have to wonder if any of GW3's past "educational deficiencies" will be brought up in one or both parts of his trial.

Death Penalty Trials are officially noted as being 2 trials. Guilt phase and sentencing phase ---which means death penalty or life w/o parole.

I wish I could be more like you also, you do good in-depth research. I will be very interested to see what you think when things REALLY get going at the end of this month!

I see GW3's attorney gearing up to provide many mitigating factors to keep GW3 from the death penalty. Diminished mental capacity is a very common and sometimes successful strategy used in DP cases.

If you look you can see some of the motions for the Wagners are for the sentencing phase of the trial....to avoid the DP if they are convicted.

DP attorneys focus on getting their clients LWOP. This is a major objective they deal with. Notice the Wagner Motions being filed that are trying to throw out the DP on grounds it's unconstitutional!

DO you think it's unconstitutional? Sorry. This is a huge can of worms maybe best left alone for now!!! :eek:

Yes. I was thinking about another case in the news where a civil suit has been filed.

Yes, I've seen civil suits filed during and after criminal trials. It takes time for them to move through the courts, so YMMV. JMO, it wouldn't hurt to have a successful civil lawsuit in place to collect on any money that shows up.

As for Fredericka Wagner, the trial hasn't even begun yet. We don't know whether there is evidence she was in some way liable for doing something to prevent the murders or in some way aided the killers.

Yes, the children need assistance since their parents were murdered and can no longer provide for them. They deserve anything that can be recouped on their behalf to pay for home and living expenses, food, clothing, education, etc. The small amount of SS survivors benefits probably aren't covering much.

I'm glad you brought this up. In no-way-shape-or form have I ever seen ANY mention of where the Wagners said they were during the murders.

Let's be clear, ALIBIS mean everything!!!! There has never been any mention of the Wagner 4 having alibis for the night in question.

My own opinion is that they told LE that they were home in bed when the murders occured.

I sure hope they do. They may not feel like going through it though, after all this is over. I hope and pray people everywhere come out like termites to file civil suits against FW!

These are just excuses for them committing the murders. For them to use these excuses it would be the same as admitting that they committed all these murders and felonies.

I believe they will totally and completely deny having anything to do with it, and will try to pin the 8 murders on drug selling/a drugged out crazy person/Chris Sr. buying up foreclosed properties/robbery/cartel/fights/road rage/money they owed but refused to pay/ marijuana grow ops/love triangles/derby jealousy/revenge and rage for this or that/anything and everything under the sun...ETC...EXCEPT for blaming and incriminating themselves....2 Cents......

I feel like we have just seen a wee bit of the evidence the prosecution has against them. Plenty more to come, IMO. I'm beginning to agree with some posters that these cases won't go to trial. Once reality sets in, the Ws will grow weary of the 4 walls and the attorneys will get tired of fighting the constant coming of cold, hard evidence. JMO. It's going to be March madness in Pike County!

My 2 Cents..... It just doesn't matter that the Rhoden/Manley/Gilley Families "might" have nothing to gain financially from suing the Wagners in Civil court.

It still is very necessary that they do this, important that these families do so, and that the Manleys, Gilleys and Rhoden Families get an official judgement on the record.

Financial situations CAN AND DO change in the future ---it is crucial that a judgement is entered by the court, in the victim's favor.

Lol, yes! Don't we wonder! I'm interested to know where they were when the victims were found. I believe some....body was watching them...once the news broke. Too many people knew about the custody issues for no one to think about the Ws immediately. Just thinking out loud...All my opinion.

I researched that today, and attorneys opinions vary. Some said a court file is public record and you just go to the court clerk's office and either look at it or pay to have a copy made. Other attorneys said, "No way!" So IDK.

Thankx for your opinions!!! But my differing opinion---with all do respect--- is that the Wagner 4 will deny deny deny until the end that they know about anything that has to do with the murders. Let's not forget how Billy, when he was in Kentucky court, pretending d like he didn't know what was going soon and as it be "guessed " he would go back to Ohio. Do you graveyard mean? This is is ACT TO PRETEND he doesn't know what the neck is going on. My 2 Cents.....

I know where you're coming from, CC. I guess I am just in awe of the discovery presented against them already. The truth is, there have been no other suspects, from Day One. I think the big puzzle has been put together. Not saying all the pieces are there, but I do believe there's more than plenty, or these indictments just would not have happened. JMO

Thanks for researching.

My question is if the state has given FW the discovery yet. Her lawyer filed for the discovery (according to the court records) on multiple dates. Then there is a January 10th listing of 'Identification of Discovery Provided Filed".

Does that January 10th entry mean that the discovery list has been provided to the court?

I am curious what would be on her discovery list.
