OH - Samuel Dubose, 43, killed by Cincinnati LE during traffic stop, 19 July 2015

http://www.usatoday.com/story/news/...incinnati-cops-shooting-trial-opens/93142162/

During opening statements Tuesday in Ray Tensing’s murder trial, Hamilton County Prosecutor Joe Deters said body camera video of the traffic stop shows Tensing reaching for his gun as DuBose restarts the car...

Tensing’s attorney, Stew Mathews, however, said his client was trying “to save his own life” as DuBose sped away, accelerating...

Testimony is expected to begin Wednesday morning.

I just.... ugh. I don't even know. "I feared for my life" is a good defense as a cop. But come on, he restarted the car so you drew your gun? If he had fled further (out of "fearing for my life" range) Tensing still would have shot him IMHO.

And I don't think Dubose "sped away, accelerating" because he was already shot in the head.

Ex-cop in Cincinnati shooting not dragged by car: prosecution expert

The car that Ray Tensing, 26, stopped in July 2015 was moving forward about a second before the former officer shot Samuel DuBose, 43, in the head, Grant Fredericks, a forensic video analyst, said at the trial in Hamilton County Court of Common Pleas in Cincinnati.

Fredericks, who studied video of the incident captured by Tensing's body camera, concluded DuBose's car moved forward one to two feet before the shot was fired, but Tensing was not dragged.

What hangs me up in all these , obviously , first is race. But secondly, there seems to be no overall differentiation between THE REASON for the interaction from the instant it is started.

They guy killed the other night had killed people. Omar was more than dangerous.

Selling ciggs, a tail light, autistic child, etc should come into decision making as far as cops go in accessing their "danger". Is it realistic to assume somewhat who just killed people is a danger to you yep.

But what is the "real reality" that someone with a burned out bulb is going to kill you to avoid a ticket, I would say pretty low.

here is some of court

, listening to his description 37:00 ish mark interesting - in terms of it happening live his story does have credibility IMO, in terms of his perceptions,---- wondering if he did not claim he was dragged if this would be different??

Have no idea why/how stuff hits me -, (just an innately observant person, my mother is like that also) , but, it seems, based on his watch, he is left handed.

I wonder if left handed people would shoot if they had a choice with their left hand?

What I dont get in any of this stuff it is like the system totally ignores video listening to Kidd testimony in background, and for ages he is being asked stuff that is clearly on the video, you then ran bla bla were you wearing a body cam bla
bla

I get wanting nuance but to go on and on with clearly concrete observable stuff just seems like a waste of time.

annual cost to taxpayers 4,125,451,142!

I did not know that their body cams erase over every 30 seconds - that is pretty much a total joke
imo come on

What do you mean they erase over every 30 seconds? I know that they constantly "buffer" 30 seconds of video (with no audio) so that they can get 30 seconds of video before the record button is pushed. Are you talking about something different?

oh good that sounds better!

Do I think this was justified no. We had an attempted flee on a minimal offense. As I am listening I am somewhat confused as it relates to a notion of a big attempt by the main players to make up a story.

It can be I think semantics, but I might say I was dragged if it was for two seconds - I think it is the 10 feet deal that is problematic

There was one thing that was bothersome, not sure who , that said "don't say anything" but I am not sure of context ?

And IMo we gotta be honest that the general personality traits of folks that want this work does have a power control satiation to it. From viewing another stop he made, he seems to have that general sense of himself. Cop ee.

I think his "stuff" was more about the victim not obeying Mr policeman, that triggered his response in terms of firing - kinda like how dare you try to take off on me - if this makes sense!

HA, all my life it has blown me away how people can do north east west south ! They all are doing it easily! If you put a gun to my head and said tell me what direction you are facing, I would have a 75% chance of getting shot!! The sun comes up in the east, how does that ever help anyone once it noon!

fascinating per prosecutor-- he starts the car - his foot on brake - brain stem destroyed by bullet - instantly dead - his foot according to prosec hit gas peddle was a reflex to body stem ceasing.

BBM. I wouldn't say that it's the general personality trait of people who want to be cops, although I do agree that the line of work attracts these types and this cop was one of them.

To me, whether he was dragged or not is almost irrelevant. He reached in the car to try to put the car back in park, which to my understanding is against policy (read that somewhere but not sure of accuracy). The reason this guy was a "threat" to the officer in the first place was because he violated policy and put himself in that position.

Also, IMO, shooting him only exacerbated the situation and did not really "stop the threat" as you can see how fast the car speeds off after he is shot. If you're caught and being dragged your goal is to stop the car, and shooting him did not accomplish that. That goes mostly to hindsight but I still think it's valid point.

Ray Tensing was wearing a Confederate flag T-shirt under uniform when he shot Sam DuBose

Ray Tensing was wearing a T-shirt bearing the Confederate flag under his uniform when he shot and killed Sam DuBose in July 2015, we learned Friday when crime scene photos were examined.

The black T-shirt said "Great Smoky Mountains, 1934" with a Confederate flag in the center of the shirt.
http://www.wcpo.com/news/local-news...t-shirt-under-uniform-when-he-shot-sam-dubose

Probably not going to have much bearing on the case, as legally it should not, but it definitely doesn't help Tensing.

Humm

been a ride here.

The truth is for all of who overtime share our thoughts - what we are really doing is sharing our belief systems based on what life has presented us.

That being said , for those of us that addicted to this, we all kinda know where we come from

I am not LE positive - as a gay man life experience.

However, as I have watched actual court stuff, I truly believe this kid was totally afraid he could get smuehed to death.

First, when is the last time any of us can remember anyone taking the stand? To me, moo, that means this guy is so befuddled that he got here.

He will share his experience and anyone would know he feared for his life.

His testimony IMO was stunningly authentic. Anyone can cry when they are facing the death chair.

BUT if you watch closely, his breathing patterns were totally congruent with a "male" trying not to cry on global television,

Follow his deep breaths, for minutes after he first lost it- its physiological. We have all tried "not to cry", its draining and in time the body has to rebreathe.

You can't fake that. Hey we might be killed for our trangession, make some tears. Watch his breathing for the next 15 minutes. The breaths are deep, gasping , physiological .

Its is fine after the fact to have all these experts, being paid thousands to come in and examine all this stuff, and in hindsight to say this or tht.

It was a three 2.5 second event. I can certainly get that if I was scared to dealth that I was gonna get run over that was in reality 3 seconds seemed like 10 feet to ME.

Hey therapist some of the stuff he authentically said were amazing to me.

He was acting squirreling, there was a gin bottle, am I dealing with a imparied person, he did resist, the car was turned on

He is tall. 6 3 that matters here as it relates to his arms and the car height, and everything that happened in those three seconds.

I could go on and on and I am not promising that I might - but I just think after watching 80% of the trial, this was a kid cop, who was totally mortified that his legs were about to be run over.

Watch his stops earlier that day (and this one) he was professional , respectful, outlining the reason for the stop.

Now, I have to say that upon learning from the court hearing, that his race ratio of pulling over 87% AA - the highest in the dept, understandably bothersome.

He also had the highest whatever pullover rate.

BUT in this incident, I authentically believe that he was mortified that his legs were about to get chopped off by the rear tires.

Hey give me something -I am fine with changing my perceptions.

At this point , I think he should be charged with nothing- he was petrified.

Ray Tensing trial: Jury says it can't reach verdict; judge tells them to keep deliberating

http://www.wcpo.com/news/local-news...g-up-the-jury-in-the-ray-tensing-murder-trial

CINCINNATI - “Judge Megan Shanahan says she ordered the jury in the Ray Tensing trial to keep deliberating after they told her they couldn't reach a unanimous verdict on either charge in the fatal shooting of Sam DuBose.

"It is desirable that this case be decided,” Shanahan told the jury in her courtroom just before noon Friday. “You were selected in the same manner and from the same source as any future jury would be. It is your duty to decide the case if you can conscientiously do so.

“You should listen to one another’s opinions with the disposition to be persuaded. Do not hesitate to reexamine your views and change your position if you are convinced it is erroneous. If there is disagreement, all jurors should reexamine their positions, given that a unanimous verdict has not been reached.”

I'm going to riot if it's a mistrial. I swear. Life has pretty much stopped here in Cincinnati to prepare for this verdict.

It's interesting how differently a hung jury is being handled in this case compared to Shannon Kepler's trial. The judge sent them to deliberate at 5pm and they went until 2am and then called a mistrial on the main charge. I'm glad this judge is sending them back and not making them deliberate late into the night after a full day in court.

http://www.wcpo.com/news/local-news...g-up-the-jury-in-the-ray-tensing-murder-trial

CINCINNATI - Judge Megan Shanahan isn't going to let the jurors in the Ray Tensing trial off easy - even after they told her they couldn't reach a unanimous verdict on either charge in the fatal shooting of Sam DuBose.

The judge had two opportunities to declare a hung jury Friday and passed on both. The first came before noon when the jury informed her they were deadlocked after 16 hours of deliberations. She ordered them to keep trying.

The second happened six hours later. The jury still hadn't reached a verdict, but Shanahan didn't throw in the towel. She sequestered them for the third night in a row and told them to resume at 8 a.m. Saturday.

I have watched a lot of this. I really like her - she is warm, seems knowledgeable, isnt a power control freak - that other (the one that you dont even need a trial for where he shot the guy in the back 9 times ugh) that judge in that case is obnosious.
