Blankenship competency appeal dismissed

County prosecutors sought the evaluation on the grounds Blankenship has regularly been under the care of mental health professionals and has multiple diagnoses, according to court records.

Blankenship’s public defenders, Marie Lane and Margaret Brunarski, have opposed the ruling, saying Blankenship can consult with her attorneys and has not indicated she is incompetent.

Lane has stated in court filings that the prosecution’s true motive for seeking the evaluation is to access confidential treatment information about Blankenship they would otherwise be prohibited from obtaining.

“The state argued that it believed that Kelsie may not have understood that her actions were wrong, which is ironic since the state does not want to reveal these alleged actions to the defense via a more specific bill of particulars,” they wrote.

Lane and Brunarski have requested that if the court moves forward with a “forced psychological exam” that any report that comes from it be sealed, and prosecutors shouldn’t be allowed to review it.

“If the state’s true purpose is not nefarious, then the state should be satisfied with simply receiving the determination that she is, in fact, competent, and not need any further information contained in the report,” they wrote.

Gurto is due back in court July 31 for a motion hearing. A jury trial, which had been scheduled for April 2, in his case was continued until a later date.

*Status Hearing (@ 1pm ET) – OH – Sereniti Jazzlynn-Sky Blankenship-Sutley (13 mos) (Oct. 17, 2017, Conneaut) – only for *Joshua Dale Gurto (37) (mom’s BF) charged (10/12/17), arrested (10/25/17) & arraigned (10/23/18) with aggravated murder, murder, rape, felonious assault & domestic violence. Plead not guilty. $1M cash bond or surety.
Arrested in PA extradited (11/7/17) back to OH.
Trial set to begin 1/8/20.
10/25/18: Trial set for 4/2/19. 3/25/19 All hearings & trial were cancelled & will be rescheduled.
4/2/19 Update: Next Motions hearing on 7/31, Plea Deadline hearing on 9/30, Status hearing on 10/30, 11/27 & 1/8/20.

10/23/18: Trial was 3/5/19. 3/5/19 Update: 2/25/19: Defense's motion for stay of execution order granted. Motion for competency evaluation. No further dates available. Case disposition was transferred to "No Judge". On appeal.
4/2/19 Update: Motion filed to reconsider Competency evaluation. Next Motions hearing on 6/21. Sent to 11th District Appellate Court. 6/21/19: It is ordered (8/5/19) that the forensic psychiatric center of Northeast Ohio examine the defendant for the purpose of determining whether or not defendant is competent to stand trial. Competency hearing on 9/30.
