On Monday the case enters the penalty phase, which is expected to last several days. Prosecutors will call witnesses to testify to the “aggravating circumstances” related to the case, while the defense will call witnesses to provide “mitigating factors,” or reasons why Worley should not be given a death sentence.

Mitigation testimony could include information about a defendant's upbringing and background, mental capacity, substance abuse issues — anything that could serve to humanize the defendant and mitigate the call for the death penalty.

“You will need to make a determination as to whether or not the state has proven beyond a reasonable doubt that the aggravating factors outweigh any mitigating factors,” Fulton County Common Pleas Judge Jeffrey Robinson told jurors after they returned the guilty verdicts. “If you do so, you will be required to give the death sentence to the defendant.”

For sentencing consideration, what matters most are the two aggravated murder charges. Because jury found Worley guilty of those with death penalty specifications, it moves on to what they will listen to this week & will deliberate again: life in prison or death

Delayed till 1pm. Aparently the first witness that was suppose to show up did not show up. An officer explained to our family that everyone is upset at JW including the defense team and the judge. Officer said just sent JW down to a room alone. JW would not sign some sort of paper. Judge is trying to "whip the defense team into shape" but 1pm. Weird day. We say there forever just waiting.

thanks so much for filling us in, lcat! I regret that he is getting any delay. And how is it a witness is delayed this long? It’s not like they didn’t have time to prepare. Sheesh. Hope the judge had a stiff whip :whip:

I know. I hate that we are so “in the dark” about what is happening, so I cannot imagine being one of the family waiting to have this settled. It’s the waiting and not-knowing that drives us crazy. But they have even much more of a need that most of us. I am hurting, saddened, and a little angry at this delay today. And I know better.

WTOL News (TV) live report:

they don’t know what is causing the delay. A doctor was to testify about family life and past, and three distant relatives expected. Judge has not taken the bench; family is “in and out”. Expect to start @ 1pm.
