The men accused of holding a 13-year-old girl against her will are facing new charges.

Timothy and Esten Ciboro have been indicted on rape charges. Timothy is facing five counts of rape, and Esten is facing three counts.

The father and son are accused of locking Timothy's step-daughter in their basement.

Lucas County Common Pleas Judge Linda Jennings rescheduled the trial of a North Toledo man and his son charged with endangering children and rape for Jan. 23.

Timothy Ciboro, 53, and Esten Ciboro, 28, both of the 800 block of Noble Street, had been scheduled for trial Monday but told the court they needed more time to prepare.

update of Tuesday's trial day: 14 year old victim will be back on stand today, with her comfort dog

She told the jury she planned her escape by hiding a key to the cuffs then made a run for it when no one was home.

Timothy, during his cross-examination of the alleged victim, referred to himself as her dad during testimony. She later asked him to stop referring himself as her dad because she said Timothy never treated her as such.

"I'll try not to refer to me as your dad," Timothy said, "even though, like I said, dad doesn't have to be biological. I believe I treated you just like I treated any of the other children."

Prosecution wrapped up questioning today. Defense took a long time to question the 14 year old victim, focusing on "good memories they shared". Her questioning ended today, after about 7 hours of testimony.


The second victim, the 9-year-old biological daughter of Timothy Ciboro, took the stand later in the afternoon.

She started with good memories, then testimony became more detailed on the abuses.

She told the jury, she was forced to sleep with either Timothy or Esten nightly. She said she was forced to perform oral sex for her father Timothy and her step-brother Esten before nap time and bedtime. She said they also touched her inappropriately.

She also testified that she often had to be the one to unlock her step-sister from the handcuffs that kept the teen chained in the basement. She also said her step-sister was forced to wear handcuffs outside the basement. The cuffs would often be attached to weights.

During the 9-year old's testimony, Timothy asked to fire his standby attorney. The attorney was stationed in the courtroom to step in and represent him if needed. [request was made for "Lack of help". Request was denied]

A DNA expert testified after the 9-year-old victim.
The witness told the jury the now 14-year-old's DNA was found on the chains and handcuffs found in the basement. There was also a slight trace of Timothy's DNA as well.
Before court let out, Esten asked the judge to be allowed to add a witness to the witness list. However, the judge denied the request because the defense were supposed to have their witness list released by Friday.

The state called several more witnesses Thursday to testify against Timothy and Esten Ciboro, the father and son accused of raping two young girls who lived in their home.
After state rested their case, Timothy's biological son testified he was also sexually abused by Timothy Ciboro. [called by the defense]

While on the stand, the boy testified he was also sexually assaulted by his father Timothy.
