The judge has reserved ruling on the guilty plea of a man accused in the attack at Vaughan Foods in Moore, Oklahoma.

Alton Nolen, 32, stayed silent going into the courtroom. But once inside, he spent much of his hearing rambling on about this Muslim faith and trying to fire his court appointed attorneys. He even prayed in court and called the judge a heathen and a pagan.

“The judge is being very careful making sure that Mr. Nolen's rights are protected,” said Greg Mashburn, the Cleveland County DA trying this case. “But at the same time if he has made a knowing and voluntary plea, then we can proceed on. But she wants to make sure we don't do anything during the court process that causes this case to be reversed down the road.”

The DA says he still plans on seeking the death penalty, but understands why the judge is proceeding so carefully. “We'll take it one court date at a time,” said Mashburn.

On Monday, Nolen was in court for a competency hearing.

"We've had, on occasion, defendants act up in the courtroom,” said Cleveland County District Attorney Greg Mashburn.

Jumping up from his seat, Nolen resisted deputies

"Today, having the disturbance in the courtroom, not knowing if he was wanting to stay and be a part of the rest of the proceedings - that's why the judge asked him if he wanted to stay or not,” Mashburn said.

When Nolen couldn’t answer the judge’s question, he was removed from the courtroom.

If the judge determines Nolen is competent, the trial will move on to the punishment phase.

A man charged with beheading a co-worker and trying to kill another co-worker at an Oklahoma food processing plant was found competent Thursday to plead guilty to murder.

The ruling means that Alton Alexander Nolen, 32, could be sentenced next week, if he doesn't change his mind about pleading guilty. Nolen had announced in May 2016 that he wanted to plead guilty and be sentenced to death, but a Cleveland County District Court judge had ordered a mental evaluation to determine his competency.

"I think Nolen has been the most evaluated human being I've seen in my career," Judge Lori Walkley said Thursday as she ruled that Nolen was competent. "His behavior is bizarre, there is no doubt. However, the defense did not meet their burden (of proving incompetence)."

Hufford's daughter, Kellin Hufford, expressed satisfaction in a statement released after Walkley's ruling.

"My family and I are extremely pleased he was found competent to plead guilty. We understand the importance of finding justice through the judicial system, and now it appears to our family he will receive the greatest sentence possible as punishment for his heinous acts," Hufford said.

Death penalty still possible for beheading suspect
The death penalty for accused murderer Alton Alexander Nolen is still on the table.

Cleveland County District Judge Lori Walkley ruled during a hearing Friday that Nolen is not intellectually disabled and, therefore, if convicted, he could still receive the death penalty — something Cleveland County District Attorney Greg Mashburn said the prosecution will pursue.

Nolen was forced to appear Tuesday morning, at which point the judge asked him to stand by the guilty plea he wanted to make last February.

The courtroom was cleared shortly after Nolen entered.

The man reportedly kicked the swinging door because he did not want to be in court today.

"After that, the defendant put his fingers in his ears and refused to participate in any of the court hearings and didn't answer any of the judge's questions," Cleveland County District Attorney Greg Mashburn said.

After deputies got Nolen under control, he refused to reaffirm his guilty plea.

"He wouldn't even acknowledge any questions being posed to him at that time, so we couldn't go forward with the guilty plea this morning," said Mashburn.

His case will now go to a jury trial.

"It’s been a roller coaster ride for the families, it’s been a rollercoaster ride for us. If I had my way, he’d be all the way already on death row but there’s a process we’ve had to go through to have a fair proceeding and the judge has done that. Unfortunately, we’re just not there yet," he said.

The trial is scheduled for May 31. Officials say a jury trial could take three to four weeks to complete.

After he was found competent, Nolen refused to reaffirm his guilty plea, which sent the case to trial.

The jurors were asked if they could consider all three punishment options of death, life with the possibility of parole and life without the possibility of parole. Anyone who was firm one way or another was dismissed.

On Wednesday the final 12 jurors and two or three alternates will likely be chosen.

A jury was told Thursday that murder defendant Alton Alexander Nolen beheaded a co-worker in 2014 at a Moore food plant because of delusional religious beliefs.

"He believed it 100 percent that what he was doing was right," attorney Shea Smith said in the defense's opening statement to jurors.

Cleveland County District Attorney Greg Mashburn, though, told the jury the evidence will show Nolen made choices in carrying out the attack that prove he knew what he was doing was wrong.

"This defendant was purposeful and deliberate," the prosecutor said in his opening statement. "He was clear in his thoughts and intent."

After the opening statements, District Judge Lori Walkley went over with prosecutors and defense attorneys what photos jurors will be allowed to see.

The judge ruled jurors will be able to see one photo of the victim's severed head at the plant. Defense attorneys had complained that photo was too prejudicial and unnecessary.

He identified murder defendant, Alton Alexander Nolen, 33, of Moore, as the man he saw repeatedly sawing at Hufford's neck after throwing her to the floor.

"I was looking at something horrific, something that people shouldn't have to see, pretty much powerless to do anything about it," he said.

Traci Johnson testified. She was nervous as she walked into the courtroom to face her assistant. Johnson was severely injured by Nolen in 2014. She held the assistant district attorney's hand as she walked in the courtroom.

Johnson was getting ready to change in the locker room close to the end of her shift, when she heard "bloody murder screaming". She said she saw Colleen Hufford injured. Johnson was planning to change and sit with Hufford until help arrived, but she encountered Nolen.

"When I saw the defendant, I was frozen. I couldn't move. And I saw the knife with the blood on the knife and he made a mad dash toward me and pushed me up against the wall and held me up with his forearm against the wall and just started splicing my neck," said Johnson.

Her jugular veins were damaged, her face and finger were cut.

Johnson said, "He was just going back and forth like he was just cutting a piece of meat."

In those tapes Nolen answers questions in a very matter-of-fact way with seemingly little emotion. He told the investigators he beheaded Hufford because he felt oppressed as a Muslim. Nolen carefully explained his interpretation of the Quran and said no one guided him in the religion and that he came his beliefs on his own.

The expert witness, psychologist Antoinette McGarrahan, told jurors she diagnosed Nolen as having schizophrenia.

"I do think it has gotten worse over time," she said.

She also described him as hyper-religious. She testified he said things like "in the name of Allah" when it really wasn't appropriate to what was being asked.

A religious expert, though, testified for the defense Monday that Nolen's justification for the beheading is not found in the Quran at all.

"It does not exist," said Robert Hunt, a professor at Southern Methodist University and the author of "Muslim Faith and Values: What Every Christian Should Know,"

Hunt explained to jurors that the Quran teaches Muslims that striking an enemy at the neck is acceptable in war, not to resolve a personal insult.
