March 9, 1976.

An appeal from the District Court, Tulsa County; Margaret Lamm McCalister, Judge.
Donald Dan Morris, Appellant, was convicted of the crime of Burglary in the Second Degree After Former Conviction of a Felony; his punishment was fixed at a term of ten (10) years under the direction and control of the Department of Corrections of the State of Oklahoma and he appealed out of time by permission of this Court. The judgment and sentence appealed from is AFFIRMED.

The Appellant, Donald Dan Morris, hereinafter referred to as defendant, was charged, tried before a jury, and convicted of Burglary in the Second Degree After Former Conviction of a Felony in the District Court of Tulsa County, Case No. CRF-74-1079. Punishment was assessed at a term of ten (10) years in the custody and control of the Oklahoma State Department of Corrections. From said judgment and sentence rendered on the 30th day of October 1974, no regular appeal was taken. An application for post-conviction relief was subsequently filed. Relief was denied by the trial court, and this Court, after reviewing the record and the trial court's finding that the failure to perfect the regular appeal was no fault of the defendant, subsequently granted this appeal out of time.

Cases submitted to NamUs, and all agencies involved.

Fugitive Donald Dan Morris went missing on July 2, 1977 in Hodgenville, OK, and then on July 13, 1991, an unidentified male was 'found near railroad tracks. Near a shack used by homeless persons. Possibly went by the name of "Pops"' in Atlanta, GA. Mr. Morris has the forehead and frown lines, brows, eye shape, nose, and lips that I was looking for to matchup to the UID. Morris' hairline appears higher but his head is tilted back when compared to the UID.

The UID has a left index fingerprint in the images of his NamUs case file, and I would suspect missing fugitive Morris has fingerprints on file as well as he's served at least one other criminal offense.
