If he had a reasonable belief his life was in danger, I wouldn’t necessarily think he was in the wrong in shooting. I agree he should have called the police.

His past experience may have contributed to concealing the bodies IMO. He’s had quite a few instances where his property was stolen before. See: OSCN Search Results

I totally agree with you. JK probably knew exactly who was stealing from him and was just waiting to catch them in the act. While I believe people have the right to protect self and property, the way he took it further and "disposed" of their bodies only made things worse for him.
Absolutely. I remember that guy who knew a couple teenagers had burgled his house in the past. He hid in the basement the next time they tried it, and gunned both of them down.

He was ultimately convicted of first degree murder.

I agree with both of you that the prudent move would be to call the police afterwards. And he will most likely be charged with tampering/abuse of corpse/ etc.... That would not negate self defense though
No one is claiming it would negate self defense. We are saying that not calling and then running doesn't make it likely it was self defense. LE has said they interviewed him and at no point has LE even hinted that self defense could be at play. The circumstances they have laid out (murder scene not on the property - but next to it, dismemberment, bodies disposed of sometime Sunday night, then running....) does not smell like self defense to me. But you can believe whatever you want.

If he is actually found alive, I agree. First degree murder. I am not counting on them finding him alive. I do worry about a murder/suicide happening with his wife. (PURE SPECULATION on my part).

I can definitely see the justified killing 4 people if they were caught committing a burglary and they started to come after the person who caught them. At that point, though, LE should have been called so the dismemberment thing is strange.
Maybe he didn't want to go through the previous experience from 2012 again? We'll likely never hear his reasoning, twisted as it would be.

“That belief is based on information supplied by a witness who reports they were invited to go with the men to ‘hit a lick’ big enough for all of them,” he said, using slang for obtaining money illegally.

My guess, he used one of the scrap vehicles from the second location to transport the remains. That vehicle has probably been disposed/scrapped/whatever its called by now and is unlikely to be found. Heck, he could've cleaned it well, sold it to an unknowing company as part of a normal business transaction and we may not ever know what it was. MOO

I don’t believe anything one way or another. It’s simply a possibility

Lots of businesses that operation weekends make deposits Monday, they may have seen that.

Here is a link to info about the 2012 court case. I am not an expert in reading court docs but it looks like he received probation, set to expire on May 15, 2023.

I am shocked to read this. I get shooting them if he was in fear for his life, but dismembering them?

  • #533
That the men were dismembered and disposed in the river makes me believe this was not justified self defense. How they were killed needs to be known. Firearm use makes sense for controlling the four men. Were they shot in the front of their bodies which could be argued they were attacking the killer? Were they shot in the back thereby running away? Shot in the head execution style? Have to wait on LE and autopsy reports.

Cause of death and placement of injuries are important. Self defense and stand your ground only goes so far. The dismemberment and moving of bodies does not ring well for self defense.

But that wouldn't have required a bicycle trailer, surely, unless the transactions were all in coins.

Whatever they were stealing was heavy enough that it needed multiple bicycle trailers to transport. I assume back to their own garages.

The only things I can think of would have been catalytic convertors, but that doesn't make that much sense because there is only 3-7 g of platinum-group metals in one and you have to have a significant technology strip them. Not something that the 5 guys would be able to do on their own. The salvage place has the contacts to buy the metals, not the guys stealing it, surely.

And word would certainly be getting around town and back to Joe Kennedy that someone else was edging in on his CC sales.

Maybe he panicked thinking that killing 4 people isn't self defense. Surely at least one of them would have ran after one of the others was shot. Maybe they were in there stealing catalytic converters off of old cars?

I'd like to know what these guys were going to score. The 5th guy they invited go with them declined even after they told him there would be enough reward for all 5. Dang, what was it?!
I'll bet 5th guy is feeling lucky to be alive today. If he has participated in these criminal activities in the past, I hope this horrific event helps him make better choices from now on. MOO

It is premature to judge him IMO. He may have had a reasonable belief his life was in danger prior to the killings.
If his life was in danger he might have shot them and then called the police.

Dismembering human bodies is not covered under the Castle Doctrine.

You're totally right. Also, having to dismember four adult humans isn't a spur of the moment thing. Those are clearly defined actions that probably took place over a good amount of time. I imagine while disassembling human beings, you have a lot of time to think about what you're doing.
