Court documents filed in Washington prior to last week's events described the state of Jessica Smith's relationship with her estranged husband. Greg Smith said his wife sent "a barrage of text messages" between July 2 and July 7 and that he also received a bizarre voicemail from his daughter.

"The language ********used is not typical of someone her age and it sounds as though she is reading from something that Jessica scripted," Greg Smith wrote in court filings. "She made statements such as, 'I'm so sick I can hardly talk,' (and) 'I can't sleep very well because I'm tormented by the thought of you in our lives.'"

Greg Smith said in the court documents filed July 21 that he had no history of a negative relationship with his daughters, and he claimed Jessica Smith was manipulating his children in to believing otherwise. He asked the court for a bilateral custody evaluation.

The two married in 1996, and Greg Smith began to move toward ending the marriage in November 2013.
They continued to live together until April of this year. After he moved out, Greg Smith said his efforts to see the girls or call them were "thwarted or ignored."

The day the two children were found in the Cannon Beach hotel room, Jessica Smith was supposed to turn the girls over to their father for visitation, according to Greg Smith's attorney.

In a divorce petition filed on June 30, Greg Smith said the two were married in 1996 and he told Jessica Smith in November, 2013, that he wanted out of the marriage.

He claims that in April he told her he was moving out and she told him to leave immediately. Since then, he has not been allowed to see or talk with his daughters, according to the declaration.

She later moved the kids from Goldendale, Washington to Vancouver without his permission, he says.
She had filed for an order of protection against him, alleging stalking and harassment, but it was denied.
"My efforts to see the girls or communicate via phone calls have been thwarted or ignored," he claimed.

"Jessica allows my parents to see the kids, but only if they promise not to share photos with me"

He was asking for a flexible schedule in which he would see the girls at least every other weekend.

I am deducing from a few of the pressers:

1) LEO think she has been on the logging road since Friday How long did the 13 y/o lay in pain until she was found?
2) Mom has been staying in hotels with the girls. . . . since APRIL? I wonder if the older daughter got to enroll in school? Maybe the close living quarters with a toddler and pre-teen got to be too much for her?
3) Father to the children requested visitation (granted as of 7/31/14) - had he not been able to see the children since April when they moved?
4) Father requested psychological eval for custody - granted due to default (Mom no-showed court proceedings). There were other statements JS had been acting erractic (sending erratic texts). Could this be a psychotic break?
5) LEO charged JS with Aggravated Murder before the toxicology screen could be returned on the toddler. This leads me to believe they are basing the murder charges on something found already (ie: strangulation? suffocation?) if the child did not appear to be injured like cuts or stab wounds.

Am I the only one who is alarmed that the thirteen year old's name is being released, and now in this story, a photo?

I know what you're saying Knox, but under the photo it says it was provided by the family.

Smith showed little emotion, frequently looking down at the table where she sat in the jail library that doubles as the video arraignment room for inmates. Her unkempt, black hair fell down around her shoulders.

Her attorney, Willam David Falls of West Linn, asked that his client not be contacted by anyone, and specifically that no one inquire about her mental health or health issues, "and that no subpoena being issued in that regard."

Marquis quickly countered that he and never heard such a request to basically prevent a grand jury scheduled to hear the case this week from making inquiries regarding a murder case.

As he left the courtroom, Falls declined to comment on the case other to say that it would not be tried in the media.

“I still felt like I was an irritant to Jessica and everything was just difficult,” the court documents read. “… I think we just didn’t trust each other anymore.”

Greg Smith said he told her he wanted a divorce in November 2013, but he decided to continue living with her “for safety and financial reasons.”

Smith said he told her on April 11 that he told her he’d met somebody he thought of as “a good friend and more,” and that she asked him to move out four days later.

Smith said she didn’t allow him to see the girls after that, and that she only allowed his parents to see them on the condition that they not show him any photos of the girls afterward.

“My efforts to see the girls or communicate via phone calls have been thwarted or ignored,” he wrote. “Jessica states that for the health of her and the girls, they don’t want to see me.

“I just want to have a good way to communicate and work through this, while respecting her health and fragility, if it’s indeed an issue.”

On July 17, Jessica Smith filed for an order of protection against her husband, but a judge denied it. Ironically, Jessica Smith said repeatedly in the court documents that she felt her and her children’s lives were at stake.

“We feel terrified for our lives before of his (Greg’s) mental state,” she wrote.

In the request, Jessica Smith said Greg Smith was “unable to accept his behavior is mentally and emotionally abusive, as well as life-threatening, traumatizing, and unsafe to be around any longer.

“When I attempt to communicate via text due to fear and manipulation, I am verbally (only) abused and told I’m invalid, and stupid, and I should communicate per his requested method, in spite of experiencing terror at having any contact.

Smith said his wife had texted him that she planned to move to Williams, Ore., where some of her family lives – a move he was trying to prevent.

“The girls need to be close to their daddy, and that’s being stolen and pushed out of their lives,” Greg Smith texted Jessica Smith when she told him she planned on moving.

Greg Smith also said he was concerned for the girls’ safety.

“Mother plans to live near her family, yet her parents both abused her and her siblings growing up,” Greg Smith claimed in a filing on July 1. “Father believes mother has suffered PTSD throughout her life based on those experiences and she left home at age 16 due to the situation.”

Smith also told the court he was worried his wife would “abscond with the children” if she were allowed to leave the Portland/Vancouver metro area.
