Hearing upcoming on December 27 at 9:30 am. Two hours scheduled.

Hearing to dismiss the aggravated murder charge.

Judge Easterday presiding. Thank God it isn't Judge Wiles.

If this aggravated murder charge is dismissed, that eliminates the risk the death penalty. If it isn't dismissed, expect a plea bargain.

Unrelated but proof that the wicked will eventually be held accountable.

The psychopathic pot plantations that away with shooting a 12 shotgun at his landlord's children was arrested for DUI the night before Thanksgiving. He refused take a breathalyzer tests so he gets extra bonus points.

10/25/19 Update: An amended Yamhill County Grand Jury indictment for double-murder suspect Michael Wolfe includes 1 count of aggravated murder & 2 counts each of first-degree murder, first-degree murder/constituting domestic violence and first-degree kidnapping, District Attorney Brad Berry said the indictment was amended to “conform with Senate Bill 1013” related to the aggravated murder and death penalty components. Wolfe was originally indicted on 2 counts each of aggravated murder & first-degree kidnapping, in addition to 1 count of aggravated murder/constituting domestic violence. Status check hearing on 11/7.
11/7/19 Update: Officially charged with amended indictment. Defense counsel to file motion to dismiss by 11/21/19; response due 12/12/19-reply 12/20/19; Motion hearing on 12/27 for 2 hours re Defense motion to dismiss count 1 (aggravated murder) & set future dates.
12/23/19 Update: Judge granted motion to allow Wolfe to wear street clothes rather than prison clothes.

So far the Oregon Courts website only states that Judge Easterday has taken the motion under advisement. The hearing could be ongoing. Next scheduled hearing is February 10, simple status check.

Man accused of murdering Karissa Fretwell, son Billy fights threat of death penalty


On Friday in Yamhill County Circuit Court, attorneys for Michael John Wolfe, 52, argued for dismissing the aggravated murder charge Wolfe faces for allegedly murdering 3-year-old William "Billy" Fretwell, his biological son.

One of the two aggravated murder charges Wolfe initially faced after Karissa Fretwell, 25, and Billy went missing in May was already reduced after a new law drastically narrowing the use of the death penalty went into effect in September.

Previously, about 20 circumstances made a homicide qualify as aggravated murder, including murder for hire, murdering multiple people, torturing before killing, the murder of a child and murder during the course of a felony crime.

With Senate Bill 1013, Oregon legislators voted to limit these aggravating circumstances to only four:

  • Terrorist killings of two or more people
  • The premeditated murder of police officers
  • Murder committed in a prison or jail by someone who was already convicted of murder
  • The premeditated murder of a child under the age of 14

During the passage of SB 1013, all categories of aggravated murder were altered to include the words "premeditated."

The bill passed through both chambers and was signed into law by Gov. Kate Brown.

But lawmakers and officials scrambled after an email from the Oregon Department of Justice clarified that the law would apply to pending cases and current death row convictions that get overturned.

All open aggravated murder cases in Marion County, including one involving the murder of a 12-year-old boy, were reduced, or are expected to be reduced, in the wake of the law's passage.

More information has been posted. The prosecutor presented a list exhibits the court. This no doubt included the autopsy for William as well as Karissa with photos. Defense attorneys hate autopsies and autopsy photos because they compel jurors to acknowledge reality.

But much has changed legally since their bodies were found in mid-June. A new Oregon law passed this year, Senate Bill 1013, substantially limits the crimes that are fit for the death penalty. District Attorney Brad Perry said the killing of a child under the age of 14 still carries the potential for the death penalty if there’s a conviction.

The new law also raises a new challenge to prove Wolfe’s guilt.

“This is actually a benefit to him, because what the Legislature did is add an additional element for the state to prove,” said Chief Deputy District Attorney Kate Lynch in court. “It’s now more onerous for the state to prove aggravated murder than it was previously.”
