*Motions Hearing (@ 3:45pm PT) - OR – Karissa Alyn Fretwell (25) & William “Billy” Alan Fretwell II (3) (last seen May 13, 2019, reported missing May 17, 2019, Salem; found June 15, 2019 approx. 10 miles west from Yamhill on Weyerhauser property off Turner Creek Rd. LE believe they were dead on May 16, 2019) – *Michael John Wolfe (52) “father of Billy” – sought for questioning since 5/23/19, arrested (5/24/19), charged (5/28/19), originally indicted (6/6/19) & arraigned (6/21/19) with 2 counts of aggravated murder, 1 count 1st degree murder/constituting domestic violence & 2 counts of 1st degree kidnapping. Indictment amended (10/25/19) to 1 count of aggravated murder (for Billy), 4 counts of 1st degree murder & 2 counts of 1st degree kidnapping. No plea entered yet. Held without bond.

12/27/19 Update: Judge takes motion to dismiss count 1 under advisement. Next status hearing on 2/10/20. 2/7/20: Judge Easterday denied the motion to dismiss the Aggravated Murder charge. 2/10/20: DA to respond to defendant's motion to dismiss by Feb 21. Defense to reply by Feb 27. Defense said they would be ready to go to trial in 12 to 18 months. Hearing on motion to dismiss set for Mar 3, 2020.

I can't really imagine how this isn't a capital case other than the exertion of influence. I have seen too many cases recently where men have been confident that "good old boys" can protect them from prosecution in crimes against children. I think there's a need for these loose organizations to make it more clear that is not to be the case.

If I read the article correctly, he is still eligible if found guilty of aggravated murder of Billy?

Otherwise, it also says a life sentence could mean eligibility of parole after 30 years. Granted, he’d be elderly but I would be so disgusted if he ever had freedom again after taking Billy’s and Karissa’s lives.

It’s not lost on me that MW also has children that are losing a father and I feel bad for them as well.

I’m just so very sad. And I’ve been following Gannon’s case. Seeing those charges unfold yesterday and the confirmation that they believe Gannon is gone brought all these feelings to the surface again.

New Oregon Death Penalty Rules Affect Old Cases, DOJ Finds

Aggravated murder is the only capital crime on the books in Oregon. Rather than seeking to do away with the death penalty entirely, which would require a public vote, death penalty opponents in the Legislature took a more novel approach this year: changing the definition of aggravated murder.

Once the law kicks in on Sept. 29, only terrorist acts that kill at least two people; premeditated murders of children under 14 years old or law enforcement; and killings in prison by convicted murderers will qualify for the death penalty. Moving forward, many crimes that currently qualify as aggravated murder will be considered murder in the first degree, not punishable by death.

Court rules no death penalty for man accused of killing Karissa Fretwell, toddler son
The lone aggravated murder charge against Michael John Wolfe was dismissed by Judge Cynthia Easterday after his attorneys argued over the constitutionality of the charge.

My understanding was MW’s attorneys argued that because he wasn’t likely to pose a threat of further violence, however nebulous that concept is, he had some kind of disqualification under the new 1013 rule which retroactively applies to all potential death penalty cases. Prosecutor is appealing the ruling, but that’s also likely to delay trial.
