According to the Sheriff's office website:

Some charges have been dismissed and the others have been REDUCED:

The sexual abuse charge has been totally dropped.

The rape and sodomy charges have been changed from Rape 1 and Sodomy 1 to Rape 2 and Sodomy 2.

If true, this is GOOD news for the victim. It appears to mean there was no "forcible compulsion." :twocents:

Rape, Sodomy, or Unlawful sexual penetration [2] in the 2nd degree: the victim is under 14 years of age and the attacker is 3 or more years older than the victim.
The crime occurs whether or not the activity is consensual. Class B felony.

I guess he has a good attorney since he should be charged with any and everything they have. Did the judge drop those charges or the DA? Maybe with the charges left, he will now camp out in jail forever.

Kelsey Patrick McCune, accused of kidnapping and raping a 13-year-old Oregon City girl in December, will be sent to the Oregon State Hospital for a mental evaluation.

Clackamas County Circuit Judge Kathie Steele approved the transfer Friday at the request of prosecutor Rusty Amos.

Amos sought the evaluation because McCune's attorney, Stephen Kelly, plans to use an insanity defense. A defense psychiatrist concluded McCune suffers from a delusional disorder characterized by grandiose beliefs and has anti-social personality traits.

McCune is being held at the Clackamas County Jail. He attended the hearing via video and stared down and responded with one- or two-word responses to Steele's questions.

A trial date will be set when McCune returns from the hospital.

McCune, 40, is charged with kidnapping, rape, sodomy and sexual abuse. McCune, who knew the girl's family, is accused of taking her from her Oregon City home in early December.

The girl's disappearance set off a four-day search for the pair that attracted national attention. Police found the girl and McCune on Dec. 7 near the girl's home.
