In other words, the survivor has to go through the whole equitable distribution thing. They don't get to stop the divorce and keep all the goodies. The heirs of the deceased spouse get the equitable distribution money.
I think the law only applies if one of the parties paperwork has actually been filed with the court. Not sure if lack of service on the other party would make a difference.
