Parents Sue Hospital After Stillborn's Body Was Sent To The Cleaners

I agree that it adds insult to injury.....
However a lawsuit is a looong drawn out process which in many cases only serves to relive the trauma..

I am not defending the hospital but I question if suing is really needed.
depends on how it ends. will it force the hospital to change policy or to actually follow policy they already have? the baby's body should have been checked into the morgue not just dropped off. when laundry is collected in the morgue it should be checked to make sure it does not contain body parts at the very least for the public health. what will force the hospital to show reasonable care? why change the way they behave if they do not face a penalty? if they are just going to do the right thing because it is right we would not be in this position to begin with.

I tend to think of negligence as something harming a living person.
I am sure this further emotionally upset the family.. BUT in reality when dealing with such a thing they probably needed someone to blame for something.
Its just human nature.
I am not sure what the cause for the lawsuit is???
Yes ... its emotionally tragic ... but worthy of a lawsuit??
Only if the hospital is responsible for the baby being stillborn. Then this would take on a twist of covering up responsibility.

According to the initial post and news report:
The lawsuit contends Huguley Memorial Medical Center breached its duty to care for, handle, maintain and/or prepare for burial. The lawsuit alleges negligence, which is the failure to extend ordinary care, and gross negligence, which shows either reckless conduct or conscious disregard for the family's rights.

There are all kinds of negligence. I think that it was a mistake, but points to an insufficiently enforced policy in the handling of a stillborn baby's remains, at the least.
IF you have ever been inside this hospital, it would be a little clearer how it could happen. It's very disorganized, almost haphazard in most ways.
