What 4 year old goes to the bathroom "to take a shower"?! There's a special place for monsters like this woman - it's called prison. Once those women in prison find out she killed her own 4 year old she will wish someone had killed her for not brushing her teeth.

Yet another "momster." I will never, ever understand what these parents tell themselves that make it okay to physically assult their child when they - the parent - become frustrated.

What burns my butt the most is that it will be presented as the mother didn't realize that kicking her daughter in the stomach would cause deadly harm so it will be looked at as child abuse at best. It should IMO be classified as attempted murder because the parent outweighs the child by so much that even the most clueless person would know that they could kill a child if they kick, hit or stomp on them.

I wish that the laws would change to read that it is assumed that any person who assaults a child knows that there is a possibility of great harm or even death due to the difference in the size and weight of each of them. IOW, when a parent/caregiver loses their cool and strikes out at a child the law should protect the rights of the child by assuming the parent/caregiver is aware of the unbalanced weight distribution.

Look at it this way - if someone kicked or stomped on a kitten and the kitten died it would be assumed that the person knew they could kill it because a kitten is so tiny. Why then don't we apply that logic to children?

Ooh, I'm soooo mad!

And there you have it - Mother Charged with Child Abuse of Four-Year-Old Daughter.

Not attempted murder, not second-degree murder, just child abuse. Will she even spend time in prison?

From your link:

Hernandez Rivas told responding officers that her daughter, now identified as Nohely Alexandra Martinez Hernandez, had entered the bathroom at approximately 11:15 a.m. and started the shower. After approximately 15 to 20 minutes had passed, Hernandez Rivas heard a noise from the bathroom which prompted her to check on her child. When Hernandez Rivas entered the bathroom, she stated that she observed her daughter face down in the bathtub. Hernandez Rivas said she waited approximately one hour before calling 9-1-1.
...
Hernandez Rivas was arrested on January 28 and charged with one count of first-degree child abuse and one count of first-degree assault. Hernandez Rivas is currently being held without bond.

What a BS story. A 4-year-old went and started her own shower and mom checked on her after 15 to 20 minutes because she heard a noise? Finds her face down in the tub, unresponsive. And then waited an hour before calling 911? Liar liar. :liar:

Sounds like an ADA that is too scared to pursue charges he/she doesn't think can be prosecuted. However, the mother's own statement is her own condemnation - she let a 4 year "take a shower" and didn't check on her for 15-20 minutes. I've never known a 4 year that would even know how to turn on the water without scalding them self. My 4 year old nephew has to be talked into taking a bath and would never voluntarily "take a shower" nor would he be allowed to. No responsible parent or adult would allow it. Let's hope for a judge and a jury that see this woman for the monster she is and a she is found guilty and punished to the longest term allowed for these charges.

Worst part is---this monster will be able to go on and have another child somewhere , which she will probably do.

She is lying. Look for a BF somewhere. That is why the 4 year old was in the shower and that is why momma waited an hour before calling 911. No 4 year old gets into the shower without help and then showers alone for 15-20 minutes. Someone was washing trace evidence away and then waited until the perp was long gone before calling 911.

I think she is taking the blame for someone else, probably the man who got her pregnant at 15.

Or she has absolutely no knowledge of forensics and thought that somehow the shower/bath would be ruled an accidental downing and her crime would be concealed. It has happened soooo many times before.

Mandatory tubal ligation should be instilled in these types of cases

Fear not. There will probably be more charges depending on the COD ruling.

FOX 5 DC reported that Hernandez-Rivas is currently charged with first-degree child abuse and first-degree assault. Police are waiting on a ruling by the medical examiner on the child’s official cause of death before determining if she will also face more serious charges.

I sure hope so Lilibet! And I hope it's a real charge, like second degree murder. IMO the mother continues to lie:

Nohely was transported to the hospital in serious condition, according to reports, but once she arrived medical staff noticed multiple bruises on the child’s body as well as head trauma.

The next day when police spoke to Hernandez-Rivas she reportedly confessed that she kicked the 4-year-old in the abdomen because she was angry that she hadn’t brushed her teeth and that the child then fell backwards and hit her head on the living room wall.

Hernandez-Rivas told police her daughter appeared lethargic and got up and went to take a shower when she later found her lying face down, according to reports.

Multiple bruises and head trauma IMO doesn't equate to one kick and the child then hitting a wall - more likely little Nohely was given a sound beating by mama. And I'll bet dollars to donuts it wasn't the first time.

Knowing that they're waiting for results from the ME I feel certain the truth regarding this poor baby's death will come out and more serious charges will be forthcoming.

Agree. Sounds like systemic abuse the mother tried to explain away as a once-off.

Agree with this 100%!!
Poor baby girl😟 I can't imagine all she had to endure in her short, precious life.

I'm sure it wasn't the first time either. Someone "Stable" without any prior fits of Rage doesn't beat ANYONE. MUCH LESS A CHILD TO DEATH!
