I concur with the majority and believe that this motion probably has something to do with DC.

But as I was reading the various posts about the fact that keeping it from the defense might mean that it actually has something to do with the defense team made me think of Mort. He has definitely done some things that I don't think are above board. Trying to dig up dirt on RK by doing those very questionable video taped "interviews." Makes me wonder what else he might have been up to.

We don't know who JJ recorded when he was interviewed by the defense team, do we? Was it Baez? The SA could not listen to the tape because it was made without the other person's knowledge, but would that necessarily exclude LE from listening to it as well? I would think if they were investigating an offense, i.e the unlawful recording, they would listen to it. What if information was discovered during the "investigation" of this offense? Were Baez and Co giving JJ explicit instruction about what to say in reference to where he searched and what he saw?

In Lee's deposition he was asked if he knew anything about Dominic Casey going out into the woods off of Suburban Drive and he said YES. He said that his mother told him, before the remains were found, that Dominic went out into the woods because they got a tip from a psychic. Lee even tells them where this conversation took place. In the Anthony kitchen.

The SA asked him if he was sure that it was before December 11th, 2008 and he said YES because he was mad (he used another word) because he didn't understand why all the sudden they were willing to look for a dead Caylee.

Cindy has denied any knowledge of Dominic Casey going out there until after the remains were found. Well again, Lee says differently and why would Lee lie about his own mother in regards to this?

Cindy KNEW and I believe that it is CINDY who sent him out there. Why else would she lie about it?

This is the tit for tat that I do not believe the Judge is happy with. The defense holds out their witness list until the Sa comes full disclosure with discovery. I don't know if that is a typical strategy or normal or what. Perhaps a good question for one of the Lawyers.

Do they really expect the defense to give up a witness list until the Sa gives up all discovery? I do not know the answer to that. I do know that the defense has no intentions of giving up their strategy, nor are they required to.

I have thought about who would be on the witness list for the defense. Perhaps Hl , Dr Baden, Dc, JJ, various experts. Most of the witnesses are already on the States list, so the defense can use them in cross.

I am frustrated at the system. Both sides appear to be playing a tit for tat game over discovery and somebody's life hangs in the balance. I wish they would just get all the information on the table and lets move on to trial. Moo

There has been no tit for tat. If that was going on, then the defense wouldn't have recieved anything after the first document dump, until they turned over something...

5309 claimed the sound came from the woods on the NORTH side of their home. The school is found exactly North of their home.

The officers walked in the area south of the woods, all they heard was sounds that they later confirmed was children playing at the school.

IMO they are investigating someone else and can't release the information because it ties to them. Perhaps the person who told Dom to do something other than call LE if a body is found. Or Cindy! Can't tip them off else they interfere with an investigation.

That was my first crazy thought too.... Honestly, if they don't want it released there must be someone else of interest. Granted, I think Casey Anthony is as guilty as can be- that or she is the most callous, cold hearted person I have ever seen on public display.....but there has to be someone else involved is what I am thinking....

However, in the police report it does not mention a cadaver dog. It says ocpd K-9. Totally different. And several more officers showed up to search the area.

It was called in after asking several other folks in the area if they heard anything (they had not) and before they talked to the school.

There is nothing about that being a cadaver dog as you originally cited. Did you embellish that or can you provide a link?

However it does state in that article, "Officers said they did not go into the wooded area because of thick vegetation and that the ground was very wet -- some parts covered in deep water."

Since the call in question was about a young person yelling for help, they were not looking for a cadaver. But a live person. There would have been no reason to bring a cadaver dog.

There is very strong evidence, botany and insect evidence that blows that theory out of the water. Those roots growing throughout the skull, the hair mat, the pooh blanket, the canvas laundry bag prove that the remains had been there since late June/early July.
The insects indicate that spot was the primary decomposition site. The remains were not placed at a later time.

Why would this be something that the defense could not see, though? Even if the state was being childish with their motion, which they have yet to behave as I have seen, Judge Strick would not keep this info from JB, it's theoretically "exculpatory" if the defense wants to argue from that angle, so it's not something JS would delay.

Anything and everything is possible.

However, we discussed photos in prior threads and while may be possible to prove the presence of something, it is impossible to prove the absence.

As an example, a wide shot may align with the location that the remains were found but to know and see the remains were not there, you'd need a close-up down low and under the palmetto and this is nothing anyone ever expected to look like a 'body'.

A close-up has no reference so is this THE palmetto that the remains were located under OR some other palmetto. It proves nothing!
