I just wonder if JW has a picture that is questionable. Perhaps you can see the disney bag, but not the skull. Something Jw did not see in the pic. I am not so sure this would be exculpatory. She also said she had a video IIRC in her letter to the Judge. It is possible that it is inculpatory. JW is a little goofy imo. She could have a picture that she says there is no body, but not look close enough to see small bones in the pictures. Moo

It would not necessarily be exculpatory, that depends on the juror's final take on it-But remains site photos are something that the defense would have every claim to via discovery and AL would want these pictures immediately. Even if someone had pics that showed the actual remains, the defense and the state both get access, though the judge will seal it from public view.

It could cause an issue later if the state undermined the process by running to the judge asking for an ex parte decision on delaying discovery, without any real reason to further delay it or real reason to keep it from the defense.

Remember, this is not just about releasing this info to the public-If it was, JB would be more than welcome to view the evidence in camera as well. Asking the court to deprive the defendant of immediate discovery takes something a little thicker than some pictures. And I believe the state is learned enough to realize this, they have not been in the habit of throwing around flimsy motions, or asking for ridiculous delays sans JB & AL.

ETA-Unless they are pictures of JB and DC at the remains site together with black plastic bags in their hands....now that is a reason to go ex parte.

Since we're coming up with all sorts of scenarios, I'll just toss mine in the hat for good balance and measure. :twocents: I feel in the deep pit of my gut that something has come forth (most possibly via DC) that paints the defense, Mr. Baez in particular in a very bad way. There have been the numerous references to the more than allowed JB/KC relationship. I just keep coming back to that one. Me thinks DC spilled his guts, packed up and went into hiding and the SA wants to discuss/get guidance from the court as they further investigate this 'matter' and evaluate any evidence. It's gotta be pretty big to not include the defense.

I might be starting to lean your way-I keep going back to the interview LE did with DC, where they went off record durnig the subject of calling 911 from the remains site.
But, I think I may have been wrong about what went on during that break in tape. I think, when they came back from tape, Det. Allen's voice came on and said that they were back on record, they had discussed the issue and privilege had been discussed. So maybe DC did not tell them anything in that off-record time. Maybe he clammed up and started to argue the "I work for JB and the A's" thing that he clung to shortly after their interview.
At any rate, perhaps DC did not tell them something directly, which is why LE has this information right now-They may have been tailing and paper trailing him, like police were doing to the Cummings morons.
AD would also be a great plant to get this type of info. Last I remember, she was pretty pissed with KC claiming she was a Xanax vending machine.

Anything and everything is possible.

However, we discussed photos in prior threads and while may be possible to prove the presence of something, it is impossible to prove the absence.

As an example, a wide shot may align with the location that the remains were found but to know and see the remains were not there, you'd need a close-up down low and under the palmetto and this is nothing anyone ever expected to look like a 'body'.

A close-up has no reference so is this THE palmetto that the remains were located under OR some other palmetto. It proves nothing!

It is my opinion that I don't understand where you're going here...you can see through the plant in the one photo, which is just some random stock photo of a palmetto it seems, and that proves what???? Or are you trying to say something else? Please clarify, TIA.
