I just got back to my desk after being in meetings all morning. I'm glancing over the Tweets, but I don't see an easy answer to my main question. Maybe you guys know? How come none of this 🤬🤬🤬🤬 showed up until now?

Because there doesn't appear to be any 🤬🤬🤬🤬. What was found were viruses, and a history of accessing 🤬🤬🤬🤬 sites. The latter could be done by the viruses themselves, or the computer user, but both are different than actual 🤬🤬🤬🤬 files (movies and/or pictures) stored on the computer itself. I once repaired a computer for someone, and he had a folder of actual 🤬🤬🤬🤬 movies on the computer that he had downloaded, to watch whenever he wanted. That's '🤬🤬🤬🤬 on the computer', and none of that was found on this computer.

If there's any merit to these accusations, it doesn't appear to reach anywhere near the level of the defenses original motion, deliberate prosecutorial misconduct. As to why they had originally claimed 'no 🤬🤬🤬🤬 and no viruses', I explained the first case above, as to the viruses, there's a difference between an actively infected computer and a computer with a previous infection but where the viruses are quarantined and inactive. In the latter case a claim could be made that 'no viruses were found', but actually meaning 'no active viruses found'. It may be sloppy wording, but does not rise to the level of being an outright lie nor intentionally deceptive. You have to put this issue in the context of the entire case. How important was it to the case, and to the original investigators, to spend so much time and resources on this one laptop, when there was so much more evidence gathering and investigation to do elsewhere? It appears they took reasonable precautions in their original handling of and reporting on the state of the laptop and its contents to the extent that seemed pertinent to the case.

But the defense, being desperate for anything to make TA look as bad as possible, and therefore JA that much better by contrast, are focusing on the minutiae, because it's all they have, and of course enhancing it with all the hyperbole they can muster.

That's the thing. Jodi just tried to cover the gamut of perversion by saying Travis was into little boys, little girls and kinky sex games with grown women. That's just illogical. She said that she saw all these pictures of women's breasts on TA's lap top as an example of his deviance. A pedophile would have pictures of children, not breasts. What would he do with those if he's into children?

Exactly. If BNeu can find this stuff now, even after the 2009 "incident," then Lonnie could have found it looking at the 2008 mirror drive, and that means that the "child 🤬🤬🤬🤬" IF ANY BECAUSE I SURE HAVEN'T SEEN ANY EVIDENCE OF IT YET was disclosed to the defense long ago. The evidence available to the prosecution and the defense was the same: the 2008 mirror drive.

If the 2008 "incident" was when the computer was being picked up, before the mirror drive was created, then maybe the evidence techs should be trained not to turn OFF a computer that's already on (in "sleep mode") when they pick it up, but there sure as heck isn't any evidence that this was "misconduct" or that something helpful to Jodi was deleted that way.



Not thus far.

Let's hope JSS has the intelligence, and stamina, to rule on this appropriately.

… says the search warrant was executed on June 10, at 0953 hours. The laptop WAS found in TA’s office (later testimony indicated it was in sleep mode). And the Mesa CO Police Computer Forensic Unit evidently looked at the computer and found the last activity was on June 4 at 1619 hours (email activity).

Here’s what I don’t get: This morning, BN stated TA’s computer was turned on at 0927 hours on June 10th. That almost thirty minutes before the search warrant was executed.

I hope this is the only expert they have lined up. And I hope judge is okay with running late today.

She's gonna have to suck it up for any hope of the trial wrapping in mid-December. Given all the dark court days ahead, that's a mere 2 court weeks away.

Even so, LE didn't make any changes to 🤬🤬🤬🤬 or Travis' web history and no deletions of anything potentially exculpatory. Doesn't sound like they were doing anything shady, especially so early in the investigation when they didn't even know who killed Travis yet. No point in tampering with his computer a day after his body was found. Just no point at all. So what does it matter?

Thinking out loud here..

If they took the computer off the desk and it was in sleep mode, at some point the battery will die. Just before it does, it will shut itself down, and thus making all this baloney pointless, because no one turned it on, then off. It just ran out of power.

FYI. Per Dorian Bond's twitter, on Jan 31 he states to someone that he is CMJA investigator. Sorry I can't copy & paste it using my ipad.

If the defense is claiming state erased the 🤬🤬🤬🤬 - my question would be WHEN did the scrubbers (or eraser programs) get installed on TA's computer.

If programs where there prior to murder - state could not have purposely installed such programs to erase the 🤬🤬🤬🤬 files they did not want any one to see.
If programs where installed after murder - what date, and did it coincide with JA representing herself and did she ever have a look see at TA's computer by herself.

Why was JA so sure there were 🤬🤬🤬🤬 files on TA's computer to begin with ??????

I thought I remember something about Jodi claiming 🤬🤬🤬🤬🤬 were on TA's computer, can't remember if it was in an interview or trial. If before trial it might have been before she decided to go with the pedo defense.

Needless to say, I don't think this hearing was at all necessary after reading Juan's latest filing. He addresses everything. This all should be for Jodi's appeal process, not in the middle of sentencing.

Its a good question although LE was looking for a killer at that time and I am pretty sure they wanted to see if any evidence would show who Travis last spoke to. So they could maybe find the killer easily.

The judge that signed the search warrant was probably signed even before both those times I would think.

It is an interesting question though.

I think I'm obsessed with this trial. It's my birthday today (I'm 31!) and my friends want to take me out. My response? 'Thanks but can we do dinner rather than lunch? I've got *work* to do right now.' I hope reading these tweets count as 'work.' It sure is more exhausting than paid work!

I hope these jurors are able to see right through this 'shock and distract' strategy created and developed by Nurmi and team. No way will this lead to the dismissal of the death penalty. No way.
