Retrial for Sentencing of Jodi Arias #3

OK, I could not read the exhibits of the tweets, too blurry. Much of the rest of the motion was nothing unexpected to me, some of it we already knew.

I am intrigued by the claims of JM having in the past and currently doing/saying things that scare the mitigation witnesses away. I recall he motioned the court at one time to preclude the witnesses that he did not have access to prior to retrial because JA would not provide contact information. And I recall he told one or more witnesses prior to the guilt phase that he would not tolerate perjury, which could have scared away anyone planning on being less than truthful.

But what could JM be doing now that frightens away the mitigation witnesses? Beyond reiterating that he will not tolerate perjury, that is. I want to know more about this because as it stands now for me, it sounds like there might not really be any mitigation witnesses--or at least not a long list of same as has been hinted at.

Could it be that there really are no mitigation witnesses at all...and in order to explain that, DT are claiming JM is not allowing their testimony by way of preclusion or some form of intimidation?

I am only guessing based on what I read. But of course I didn't read the alleged tweets so if those contain all the answers, someone please give me a heads up. TIA.

I think they are specifically referring to ALV and Patti Womack. But I'm sure he has already cited what he believes to be the real reason they won't come back. Besides, it doesn't fly. If they were that important they could be subpoenaed and forced to testify.

Hmphh. Someone must have taught the Good Judge how to talk to the jurors, because apparently she didn't do this the first go around. I hope she had her A$$ reamed!
 
So AZlawyer, does he have a chance of getting the death penalty dismissed with the allegations in the motion? And if so, does that mean a retrial is a moot point as the judge will then sentence her to one of the Life options?

I've been watching Creepshow while trying to read the verbose motion, not quite sure which one is creepier, but I know which one is more fun.
 
I am certainly late to the game in replying to this but I just started reading and had to say something :).

I don't agree that the roommates should have realized something was way wrong in Travis's room and that no one would leave poop on the floor. I live with three other people, two of them are of the male gender. Let me tell you what... they would see poop and walk past it and ignore it all day long, every single day, always. A foul smell? Well, they'd ignore that too.

Wow....does husband live with you part time? He never sees the poop or smells the poop. EVER.

Maybe this experience will change her perspective on slaughter.

Even if she does eventually find herself strapped to a gurney some day, hooked up to the auto-injector containing whatever cocktail of poisons Arizona is using then, she'd have the relative comfort of knowing what was about to happen and she'd know that whatever discomfort she might feel would be brief. She would never feel any of the horror and agony Travis felt while she was slaughtering him.

I just noticed I used the past progressive tense there (for non-grammar nerds: denotes continuing action in the past). It took a while for Jodi to kill Travis, and frankly I can't even imagine what he must have been feeling during that time. Horror and agony -- but those are just words to me. I'm sure he must also have felt shock -- he knew Jodi was disturbed, but he can't have known how disturbed she actually was. Shock that she would actually attack him, shock that she might actually kill him, shock to realize he was in fact going to die.

Travis' death was cruel and unusual. By law, if Jodi is sentenced to death, hers cannot be. It wouldn't be instantaneous, but unless the machine malfunctions, she'd die within about a minute or so? I think? After first being knocked out?

Before that first injection, the warden or chaplain or someone would ask the perfunctory "Do you have any last words," and to precisely nobody's surprise, she'd say "Yes." Of course she'd have something to say, and she'd have had years to distill all her psycho venom down to one final, evil insult. Something that would make "I hope Travis' family can remember him the way they want to" pale in comparison.

As we are all too aware, though, it remains to be seen whether or not she'll receive the death penalty.
 
Totally agree with all the above. Having smelt it (very "ripe", as you put it, body) I'm unfortunately able to affirm that decomp really is unlike any other smell - and most definitely different from, and far worse than, any other smell. Definitely not the same as a rotting animal, or anything else. And 'sticky' too - You just can't wash your hair or your clothes enough, let alone get it out of carpet, etc. So, yes, I think a touch of denial going on so far as the roommates were concerned. Possibly exacerbated by the "can't be bothered" "best leave it to someone else to worry about" factor. Of course that's a terrible shame. Knowing that Travis was left as he was, for as long as he was, must figure heavily in his family's nightmares.

I'm sorry you know as much as you do about the smell of decomposition, but thanks for passing that knowledge along. I think the word "sticky" will stick with me forever.
 
It's about defendants' rights and jury prejudice. All defendants have the right to wear "street clothes" at their trials. It's a Constitutional thang.

And funnily enough, they often come in looking vaguely J. Crew-ish, often sporting eyeglasses. Maybe because there's no contact solution in jail? In Jodi's case, the defense wardrobe department opted to go full-on blah, perhaps striving for a look that was indirectly proportionate to Jodi's pre-Mormon attention-grabbing look?
 
Let's hope the State of Arizona is not billed for Zervakos' interview by the defense attorneys. Seriously, this could happen.

He's already ruined his reputation, why not make a buck if he can. Samuels and ALV got their bucks first, and then ruined their reputations. Or at least ALV did (with the help of Nurmi and Willmott who I believe set her up, at least to some extent). Did Samuels ever even have a reputation to lose? Will anyone in any way associated with the defense come away unsullied?

Attorneys for Jodi Arias file motion to dismiss death penalty, alleging misconduct by Juan Martinez, Det. Esteban Flores and wife, and MCSO.

Det. Esteban Flores AND WIFE? I was going to say this must be one of the dozens of motions to dismiss that have already failed, maybe it just somehow got mixed in with current court docs. But as far as I know (which isn't far), Mrs. Flores has not been named previously. Is she an officer of the court? In law enforcement? How can anything she has done be grounds for dismissal?

Fans find tweets from someone they think is Mrs. Flores...communicate with killer...killer demands counsel to address it. It's beyond ridiculous. I cannot verify any of this, but I've seen enough to suspect it.

Let me guess... Mrs. Flores was angry after seeing the way Jodi flirted with Det. Flores during the interrogation and went on Twitter to tell Jodi she better stay away from him or else she (Mrs. F.) would find her (Jodi) after school and kick her 🤬🤬🤬?

Baseless, vindictive motions. Yawn. It's getting old. Arias will accuse anyone and everyone of wrong-doing. Judge Stephens can expect some fine accusations from Arias once this trial is over. Arias bores me. She's just a run-of-the-mill w&ckjob.

ETA: Travis wondered how a heart beats in such a corrupted carcass. Bang on Travis, bang on!
