I don't think they were EVER "girlfriend, boyfriend." Jodi just WANTED them to be.

Not again. The defense team certainly likes to home in on the jurors. Guess they are hoping the can get rid if them all.

If it were the court video, and the lawyers had an opportunity to view and order edits of it prior to trial, and the judge had an opportunity to rule on objections to any misleading edits, then yes. :)

If it's a media video, then IMO the lawyers ought to stipulate to foundation just to avoid forcing the jury to watch the horrible court video, and/or the judge could rule there were sufficient indicia of reliability to allow it at the mitigation stage. But the lawyers would still need the opportunity to view, edit, object to misleading edits, etc.

I guarantee you that the videos used at the main trial phase were supported by proper foundation and that the defense had seen them, filed objections, and had the objections ruled upon prior to trial.

And how many months did they have to just that???

Plenty, but my guess is that they didn't do it.

ETA: My guess is that JM didn't tell Nurmi that he wanted to use the media video and/or what portions of the media video he wanted to use so that this process could occur prior to trial.

Such an out of character move/mistake for JM then. Not the not-telling Nurmi part but the "not-telling Nurmi when the law says he has to" part.

OR she was acting crazy about Travis having female friends and he couldn't handle it anymore.

The day he couldn't handle it anymore came when she peeped in on him with a girlfriend and accused him the next day. That was the day she said he ran away from her, only to be found knocking his head against the wall. No doubt in absolute frustration and anger. RATHER than hitting her. Even in that extreme circumstance he exercised control.

It seems to me that as long as both sides had the video for months, neither side has to let the other know they do or do not intend to use it. Don't good lawyers prepare for every eventuality?

IMO there is no way the judge ruled that JM cannot rebut evidence of "remorse."

I must have misunderstood the motion filled and how JS ruled on it.

I thought she said JM couldn't bring up anything about JA not being remorseful since she said she killed Travis in self defense.

I think it was in the same motion where she ruled nothing could come in about her threatening Juan nor the other infractions she has had since being housed in the jail.

I guess I read it wrong. Sorry.

Juan might not have even been aware this was something he needed to do. I mean, it's previous testimony how can you object that?

Nurmi was just trying to score points by keeping the video out. And I guess he won that point but did he really? Juan still brought the testimony in just through transcripts instead of video. It didn't make a difference anyway.

The whole premise that they had a "relationship" of any significance is ridiculous, and her descriptions of it are all sophomoric. Like, junior high school level.
