Thank you for helping. I was thinking the hold up was in determining which injuries caused his death and who inflicted them. ( fight at the other prison) as ridiculous as that sounds. Its a process, takes time I guess.
I hope they do it soon, because some channels ( small ones) are misinterpreting the AG handing this case off to a special prosecutor as defending them. I think they are confused about her saying they didnt want to prosecute these guards ONLY because that office is also representing some of them as defendants in another case.

He says more cameras are needed to capture what happens. After Brooks’ death, the state commissioner of corrections ordered the expansion of body-worn cameras in prisons and said guards must have their cameras on any time they deal directly with inmates.

They’re family members, they’re fathers, they’re sons. They’re somebody’s loved one. And you might be in there for hurting someone’s loved one. Syracuse, N.Y. — Video footage of New York state corrections officers brutally beating an inmate last month was captured by a “fail-safe” feature on their body cameras that records even if an officer doesn’t activate the camera.

Four of the officers involved in the beating of inmate Robert L. Brooks had their Axon Body 3 cameras powered on, but had not double-pushed a button to start recording. The cameras were rolling anyways.

The video recall function is a relatively new addition to Axon body cameras, Adams said. He isn’t aware of another high-profile case that has depended on footage obtained through the recall function

The family still does not know why he was at Marcy.

4. None of the defendants reported the attack. Instead, after killing Robert they concocted lies to attempt to cover up their actions and then went about their daily business as usual.


29. On information and belief, the on scene defendants knew that there were no surveillance camera’s in Marcy’s medical examination rooms and they deliberately took Robert to that location so there would be no recordings of what they intended to do to him.

TY @Tiff23fr, that report identifies Abedin Mehmedovic as a nurse. He is the one who was smirking and laughing in the hallway wearing the the tan Nike hoodie as Brooks was beaten in the exam room. What a disgusting example of humanity he is.

They said the corrections officers never expected the video to come to light and called it evidence of “rampant abuse” at the upstate New York facility.

“What troubles us the most is that this is the tip of the iceberg, we think,” attorney Steve Schwarz said, “and that’s why we’re very interested in digging deeper.”

I truly do not understand why ZERO criminal charges (that we know of) have been filed and ZERO individuals have been apprehended.

Is there is a legal reason NY can’t arrest those individuals clearly on camera making body to body contact with the victim in an assaulting fashion with assault charges?

Fake Scenario:
If person A is on camera physically assaulting person B on a random sidewalk, how soon are they charged with assault and apprehended?

The report issued by the county medical examiner’s office last week concludes that the cause of Robert Brooks’ death in December was compression of the neck and multiple blunt impact injuries. The manner of death was determined to be homicide, according to the attorneys.

“I think what this does is rule out any argument that there was some other cause of death other than what we saw on video,” family attorney Stephen Schwarz said of the autopsy report.

 
“A grand jury will begin looking at the case next week, according to the Albany Times Union.”

A criminal investigation into the beating is being led by Onondaga County District Attorney William Fitzpatrick, who was appointed last month as a special prosecutor in the case.
Fitzpatrick has said he will not comment on the case until a grand jury has taken action on possible charges. No charges have been filed.

“My investigation team is making great progress,” Fitzpatrick said Tuesday evening. “We will have comment in the near future.”

The case has drawn attention from multiple federal and state agencies, including the FBI and the U.S. Department of Justice, which are investigating Brooks' death. Governor Kathy Hochul has ordered the firing of state employees involved in the incident.
