It’s different for sure. I suspect that Moya O’Brien couldn’t hang around after seeing all of the evidence up close and with Patrick disagreeing with her counsel. I doubt he’ll provide an alibi because I doubt he has one. I think he’ll stay silent, pray the body isn’t found and hope like hell there’s not enough to convict. What else can he do if he is in fact guilty? What could he be doing if he is in fact innocent?
oh where, where is Moya?? I am devastated to think that she will not be representing Mr Stephenson .. Unless she is being understudied by Micheal Allen, just for these hearings...

He is young and not smart.

The irrefutable proof in the Greg Lynn case was Carol's brain matter that Lynn thought he had cleaned away, and the phones pinging at the same time at the same place as Lynn drove away from the crime scene.
So irrefutable that Lynn had to make up his cockamamie story because he knew he was caught, and he was old enough and intelligent enough that he thought he could outsmart the police and the jury.

The police seem as sure in this case.

imo
You’ve got me wondering if there actually was evidence found at the Mt Clear site after all. It’s been easy to assume that there was nothing there to indicate foul play or anything, but maybe there was and it’s part of the evidence.

I think the lack of a body is influencing the plea and the silence to be honest. Possibly thinks it can’t quite get across the line without that irrefutable proof.
The event that has disturbed me , probably disproportionately , is that his whole family moved right out of the state and far away the day he was arrested. This is Dad, with a thriving electricians business, with employees , Mum with a long career as a schoolteacher, one daughter in a fast track career in a Real Estate agence, I forget what the other one did, but it was sigificant.. up they went. This is very very unusual , they have every right to do it, every reason to, from my point of view, but not many families of arrestees do that. I cannot think of any , offhand,

This is not a criticism, but something drove them to make such an upheaval in their lives at that time, apart from the arrest .. that whatever VICPOL had, convinced them.

Locard''s principle.. every contact leaves a trace... she left something on him, he left something on her. They both may have left something of themselves behind at Mt Clear.

Is this the same Michael Allen?

I think there was evidence there. The police seem certain that Sam was killed at Mt Clear, and photographers snapped the forensic team inspecting the ground. Maybe staged to put the heat on PS, get him to talk. Or maybe not staged and taken with a long range lens.

Either way, the forensic team were there and looking closely.

I have wondered if she dropped her watch in a struggle there. The Under Investigation show lingered on her watch (showed a replica on the table) a few times and this aired just prior to the arrest. PS may have watched the show and searched his ute or he may have even returned to the site whilst under surveillance.

I wonder if P O S’s girlfriend is sticking by him? Her social media page still says “in a relationship”, same as back in March when he was arrested.

ADMIN NOTE:

It seems members are not reading important opening posts. This case is sub judice (which kicks in from time of arrest until there is sentencing and possibly throughout an appeal).

from: Australia - Samantha Murphy, 51, last seen leaving her property to go for a run in the Canadian State Forest, Ballarat, 4 Feb 2024 *Arrest* #12

Members who persist in making sub judice comments may experience a temporary or permanent loss of posting privileges.

IF Australian authorities contact us with concerns, the thread may have to be pulled, the discussion closed and we may have to run with a Media only *NO DISCUSSION* thread. Nobody wants that !!

Post accordingly by discussing the trial in accordance with sub judice.

Thank you.

I find this interesting (a quote from the below news article):
"With his arms folded, a relaxed Stephenson simply said the words: “Not guilty, Your Honor” when asked for his plea."

Arms folded is what experts deem to be somewhat of a defiant, closed off position. Does this indicate he's hiding things? Is he sending a subtle F you to the court and police? Surely if he had counsel, they would word him up on the basics of presentation and making a good impression? Maybe he is flying solo at the moment?

Yes, I think pleading "not guilty" but also (presumably) not co-operating, is interesting.

We will just have to see what comes at trial.

The Police Commander ( Shane Patten ) gave an astonishing press release.. without a body, he claimed, that Mrs Murphy was dead ( this was while a huge search was underway , which was called off, and the Retrieval team sent in ) that she died at 8am, approx, at Mt Clear ( near Ballarat) that she was not only dead, but murdered, and was murdered by Patrick Stephenson. That she was 'attacked'. That it was not a hit and run car accident.

Any one of these claims is astounding, without a body. From this, I reckon the quality is way beyond glittering, it's into florescent nuclear glitter territory. Whatever VICPOL has, it clearly shows these claims.
I keep coming back to this. As you say, Troops, to make any one of these claims is astounding, but all of them! It seems that seldom before was anything so cut and dried! There just can't be any defence, surely?

The heartbroken husband of missing Ballarat mother Samantha Murphy has faced her alleged killer for the first time in court.

Sending condolences once again to Mr. Murphy and the rest of Samantha's loved ones. It's got to be like living a nightmare.

They were living together. Just the two of them, from what I understand, house sitting in Scotsburn. If he presents an alibi she’s likely to be included wouldn’t you think?
