Generally speaking, and it's only general, the matters to be heard where the accused appears in person are attended to first.. they are all bought in from the CIty Remand centre by a big horse float thingy, and dealt with and then carted back to the Remand centre... then the ZOOM appearances, but this depends very much on what is going on at the Remand centre.
Is there a chance he may appear in court in person? Where does he normally zoom from?

Also, is his notification of alibi due today or Friday?
Could today’s appearance have been changed to Friday due to something to do with the alibi not being ready?

For his last court date, he appeared via video link from Melbourne Assessment Prison.

He was given 14 days to present his alibi at that court sitting, so will be due on Friday.

“Patrick Orren Stephenson, 23, sported a bushy beard as he was beamed into the Ballarat Magistrates’ Court on Thursday morning from the Melbourne Assessment Prison.”


The clerk in the Supreme Court told me the matter was adjourned from 27th November due to an administrative issue, which doesn’t sound like it is regarding the P O S’s alibi.

I can’t find anything to say that the P O S will appear in person. He may well appear via video link as he has in the past. The Supreme Court does allow video links.

It would be surprising if he appeared in person. He is a huge security risk, and I go back to his first mention, when his barrister said Stephenson had 'issues' being on remand, people with 'issues' do not get to ride in the big truck down William St. to court on a fine summers day . They are highly supervised giving a ZOom appearance from the remand centre.

I had thought they would bundle all his stuff into yesterday, since he has another hearing on 2nd Dec. but he now has two appearances very close together.

An Administrative error could be one of his administrative errors.. It doesn't mean it's a court error. .. All these dates and appearances are judicial housekeeping, paperwork, time delegation, Clerk of Court's business, transparency issues, all the stuff that gets done before a not guilty plea goes to trial. VICPOL has to table detailed paperwork , so does he ( his barristers, whomsoever they may be ) .. some delay could be due to the new stuff VICPOL bunged down from Sorrell ( PLUS TWO OTHER STATEMENTS ) that the defence is chasing down. At least, one hopes they are.

Those two statements from sources unknown are obviously crucial to the VICPOL case. or they would not have been given leave to table them at this time, but that is , in many ways, the defence 's problem, they asked for the delay, which gave VICPOL another 3 months to keep digging and come up with more stuff. More stuff that is able to be admitted as evidence, , which is the key component.
 
I spoke to the Clerk in the Supreme Court again today, they assure me the P O S case will be heard at 9am. They explained that cases heard in the Supreme Court are given their own time slot, unlike other courts when everyone is told to arrive at the same time.

So, tomorrow at 9am it is.

Why does the “21 day remand mention” after P O S just state the individuals initials “JL”.

Is he a remand spy? :cool:
Elizabeth Tueno was admitted to the bar in 2021, and is a specialist /judicial registrar, Criminal Division. She manages the Fast Tracking Division....

JL is probably some ordinary murderer up for a fast track route... !!probably a minor, perhaps, initials only,... just guessing.

Sorry to hear you can’t go em. Do we have representation or someone zooming in? Can the public even Zoom in?
We are not that advanced. There are a lot of judicial objections to it, but eventually, it will happen. Changes like this take time, and courts move at glacier speed. Slow. But inexorable.
 
That’s a clever pick up Troops. One that I could not love more.
VICPOL would still have had to disclose it to the defence, but it may have been in the middle of his trial.... awkward....... or the judge would have,, perhaps, not allowed it in once the trial started....

but, ... it has not started, soooooo. in it goes, whatever it is.. it is more than what they had originally.

Just for those outside AU and Britain, etc when it says R v Patrick etc.. it means REX VERSUS PATRICK ORREN STEPHENSON, which means, REX = The King ....... VERSUS = against This Person.

Goes back to the Magna Carta. ( I think !!! could be the Restoration!! )
 
A Post Committal Directions Hearing (PCDH) is a court hearing that takes place in the Supreme Court after a Committal Proceeding in the Magistrates' Court. The PCDH is a crucial part of the court process and is designed to ensure that the case is ready for the final hearing.



During the PCDH, the parties involved will:
  • Inform the court if there is a chance of resolving the case ( not likely )
  • State how the accused intends to plead ( repeats plea given earlier, or changes it )
  • Identify any requirements for witnesses and subpoenas ( this is the part that is missing, from the defence)
  • Discuss any issues with the trial date


The parties may also be required to complete a questionnaire before the PCDH.

It was on the list this morning,.. . for 9am.. that was at 8.57am.. It' s not on the list now, because, it's been attended to.. the list now starts with those for 9.30. 10.00

so it was updated at 9.30am , which is why , dear Rocket, you don't see him on the list!!!
