SC - Bride, Samantha Miller, dies 5 hours after wedding when DUI driver slams golf cart, Folly Beach - 28 Apr 2023

Another case that I found for comparison is the crash caused by Destiny Mills of Lexington county SC. I was surprised that she got 10 years?

A sheriff is on the hook for tens of thousands of dollars in legal fees after denying media requests for the jailhouse calls of Jamie Komoroski, a 25-year-old DUI defendant who made national news in April after she allegedly killed a bride leaving her wedding reception.

A judge ruled Monday that Charleston County Sheriff Kristin Graziano must pay $33,175 to cover the legal fees of Gray Media Group, which sued after being stonewalled on its request for the calls under South Carolina’s Freedom of Information Act.

Either way I found the calls that I read about just painful. According to Jamie, golf carts shouldn’t even be allowed on the road! Can we imagine how that’s going to set with a judge if she pleads? Also her mention of being remorseful really sounded as if she were reading a note from her lawyer knowing it’s recorded. I’ve tried to find some sympathy for this young lady (hold your fire) but it’s gotten harder to do.

This is terrible

The drunk was quoted as saying could this happen to her---her being the drunk driver. This was no accident. No one poured alcohol down her throat. No remorse. Just concern for herself.

Her being so preoccupied with getting a bond seems like she isn’t thinking beyond the next few months. I’ve been digging thru the SCDC site to see what penalties are handed down in cases like this and I think she can prepare for the worst. Even the wildest theme that a lawyer could spin will lose imo.

Calls include several between Komoroski and her father. She claims she’s nervous about how things are going to end up.

“I still don’t know why this had to happen to me,” she said.

“Bad things happen to good people,” her father said. “It’s just something that happened to you and we are going to deal with this the best we can. It’s life-altering. You are going to experience stuff you never thought of, but when it is all over and done with, you will be a better person because you will have a better understanding of what it’s like on the other side of the coin.”

Information in italics above is from the article linked. (BBM)

And they persist with the idea that this just "happened to" her. No, honey, YOU "happened to" Samantha Miller and now she is dead.

Mills' BAC was .12 and she convicted of felony DUI manslaughter. Komorski had a BAC of over .26 - not sure how you could even find the ignition or gear shifter being that intoxicated. For comparison, Paul Murdaugh's BAC was measured at .286 after the Mallory Beach boat crash. I wonder on how many previous occasions Komoroski drove after being overly drunk.

On Court TV last night, April Sampson from the 5th Circuit Solicitor's office predicted 10-15 years as Komoroski does not have a previous DUI conviction. Prosecutors will likely use her apparent lack of remorse in asking for more time.

My comparator for this case is the case of Stephanie Melgoza. She got 14 years. She was laughing and singing while waiting for blood to be drawn, and after she knew there were two fatalities. As in this case, Melgoza says "the victim suddenly appeared out of nowhere".... She thought there was only one.

Bodycam footage on Melgoza:

Yes, but it was a plea deal. I forget how long her supervision is. She should never be allowed to drive again. Have you seen the bodycam? It’s egregious.

The sentences seem to vary. In a lot of them I’m sure it’s the money talks scenario and poor do the time. In this case the driver seems to have access to some wealth.

Jamie Komoroski was charged in Charleston County with reckless homicide, felony DUI resulting in death and two counts of felony DUI resulting in great bodily injury, according to a copy of the indictment.

[...]

Her attorney, Christopher Gramiccioni, declined to comment to NBC News following the Wednesday indictment.

He previously defended Komoroski in court by noting she had "zero criminal history.”

“She’s never even been disciplined at her college at Coastal Carolina or in high school,” he said last month when Komoroski was denied bail. “I mean, she has as clean of a record as you can imagine.”

Meaning, while she probably drove drunk before, she never killed anyone or was caught. Anyone with a .26 is pretty much a hard core alcoholic, to be able to function well enough to operate a vehicle. Most people would have been passed out by then with that much alcohol in their system.

Emphasis mine.
Hmmm.
Maybe that's part of the problem ??
Omo.
