What’s next in the Timothy Jones murder trial? Legal experts weigh in (with clip)

"COLUMBIA, S.C. (WOLO) — The prosecution and defense are set to bring up new witnesses in the second phase of the Timothy Jones Jr. murder trial.

Some legal experts, who have been following the case closely, say the second phase of a capital murder trial is a whole new ballgame.

“There’s no question that this is an uphill fight. The sentiment, the emotion created by the death of these children is hard to overcome,” said Jack Swerling, a defense attorney based in Columbia.

Now that Timothy Jones has been convicted of murder, Swerling said the defense will have to call up a handful of witnesses to convince the jury why the defendant should not be sentenced to death.

“At this point, you would call in whatever additional experts you’d have. I would talk to teachers, go back to talk to employers, people from the church, neighborhood people, relatives. I’d expect what you’re going to see is someone going to tie it all up together,” Swerling said....

“The prosecution’s goal in the penalty phase is to discover all the good things about the victims and all the bad things about the defendant in question,” Gaines said...."

The defense atty telling the jury “you don’t kill people who are sick”, after the jury found that Jones was not insane, is pretty disrespectful and offensive in my opinion. If I was on the jury it would have ticked me off.

The defense atty complains about a juror crying looking at the children’s bodies in bags at the crime scene, while almost the entire defense table was ignoring the photos themselves. Everybody in that courtroom was looking at those photos, except them! They were looking at computers, playing with their phones, etc. They give the appearance of not giving a whit about those children. I’m sure that’s not true, but appearance is everything. They’re not doing their client any favors. Show some respect!

Agree. And asserting what "God needs" is just as offensive, if not more so, IMO.

Of course, though, their insanity claim shredded & rejected, the defense essentially has squat to offer for mitigation, but still has to try.

That video of Merah crying hysterically for her mother is sickening. You can hear Jones calmly prompting her several times to "say what you want to say." He's deliberately using Merah's acute pain to torment Amber.

The audio (tape) is very hard for me to understand what is being said most of the time.

Today is a very sad and hard day... I just hope Amber can one day feel happy again.

As a result of a juror becoming visibly upset, Hubbard will post autopsy photos as evidence, but they will not be shown to the jury in court. They can be viewed by the jury during deliberations.

Autopsy photos will not be shown directly to jury today, but will be submitted into evidence to allow jurors to consider them during deliberation, as they do all other evidence. It comes as a juror needed helped out of her chair after seeing initial crime scene photos. @wis10
