"...In a motion filed Thursday morning by his former lawyers, Roof objected to Gergel's stance, arguing that his inability to receive "reasonable, limited assistance" from the stand-by attorneys violates his constitutional right to a fair trial and a "reliable determination of his culpability and sentence in a capital case," as provided for in the Eighth Amendment.

"It should be apparent to everyone observing these one-sided proceedings that despite the defendant’s best efforts, there is much being left unaddressed as jury selection proceeds," the motion states. "The Court’s refusal to exercise the discretion granted it by the Supreme Court to provide the defendant reasonable, limited assistance from standby counsel is therefore thwarting rather than promoting justice."

Prosecutors have not yet filed a response to Roof's motion, but Gergel has made it plain that Roof is on a path of his own choosing, after ignoring the judge's caution against serving as his own attorney, a move he described as "unwise." While Gergel has not let Bruck speak on Roof's behalf, the judge has made it clear he would be willing to let Roof reconsider his decision and bring his legal team back on board...

On Wednesday, the final jury pool of 70 will return to the courthouse and their numbers called at random. The defense and prosecutors each can object to 20 jurors without giving a reason. Once 12 jurors and six alternates are seated, opening statements will begin..."

In Charleston shootings trial, Roof both confident and unsure

"CHARLESTON – Long pauses sometimes separate his sentences as he reads notes written by his attorneys, then gathers his thoughts. From time to time, stutters punctuate his words.

At other moments, Dylann Roof sounds confident - as he did Thursday morning when he asked the judge to delay a planned Tuesday trial start for his capital case.
“I would like to ask you for two days' delay before the pretrial. I just, I need more time to prepare,” Roof said, later adding, “When I chose to represent myself, I didn’t ask for a delay before jury selection.”

He would, however, like the process of picking jurors to slow down. The federal judge overseeing the case declined...

Throughout the proceedings, the admitted white supremacist remains attentive and engaged, making no outbursts or inappropriate statements.

University of Kansas law professor outlines perils of self-defense at trial

"...“They have to, at the one hand, protect that person’s right to represent themselves as they see fit,” said Mulligan. “At the same time, that person, even though they’re not trained as a lawyer, has to live up to the decorum of the courtroom. They have to follow evidentiary rules and all that type of thing.”

One way some judges have solved that problem is to allow an attorney to advise a person who is representing themselves.

“Sometimes, that is accomplished by having an attorney in the courtroom with the defendant who is technically representing themselves,” said Mulligan. “That attorney acts as so-called elbow counsel. While not the attorney of record in the case, they might suggest things to the person representing him or herself along the way, such as, you can’t ask the question that way, or, you should object now, that type of thing. Dylann Roof's former lawyers try to block him from representing himself in death penalty trial

"Dylann Roof's former lawyers are now arguing that the government will violate the accused Emanuel AME Church shooter's constitutional rights if they allow him to continue representing himself in his federal death penalty trial.

The filing was made moments after the federal judge overseeing Roof's hate crimes trial admonished the self-avowed white supremacist's former attorneys for pressing to play a more active role, including efforts to present evidence Roof doesn't want put forth. Earlier court filings show that defense lawyers plan to provide evidence of a “mental disease or defect or any other mental condition.”

The legal team now argues that the Eighth Amendment precludes allowing Roof to continue as his own attorney and block evidence from being introduced that could help spare him from the ultimate punishment. They maintain that the 22-year-old is unprepared to handle the complexities of a death penalty case and that allowing him to proceed would deprive him of his rights to protection against cruel and unusual punishment..."
