This may be a stupid question but can't the defense call Eddie Smith? There's been so much talk about the prosecutor potentially calling him and even DH response a couple of days ago, something along the lines of "I would love that"

He's listed under the States Witness or Both on page 3. I didn't know if there was a different formality to doing that?

Sure they could call him but would they? I don't think so. I don't think they want CES on the stand. I believe they were gambling that if they "opened the door", the state would walk through it with blinders on and put CES on the stand and if they did, DH would eviscerate him on cross. If the state thought that the defense was wanting to cross CES and therefore didn't call him, that was no big deal. What I think the defense really wanted was another appellate issue in case of a guilty verdict. jmo

I've not looked at the financial indictments for some time but I recall there were more "cashier's checks" than personal checks. Nonetheless, the checks could still be traced to AM and/or Forge. MOO

So a teller would actually generate a cashiers check. This would definitely be on high alert. imo

I agree with this. But I can’t figure why he felt the need to pitch Maggie’s phone. Why not dump Paul’s phone if he felt there was something incriminating on it? That bit is confusing to me.

He may have grabbed it in his haste to get himself out of there and didn't realize he still had it and when he did, he just pitched it. jmo

Notes to keep in mind when listening to AM:

Prosecution doesn’t need to. They had the cop testify to the lies. If pros put Eddie on the stand, the defense would try to put the murders on him. The defense could call him but probably didn’t want to bring in all the lies themselves. Also, for both sides, I think he could be a wild card and testify to some crazy thing.

AM was all about sending people to cash checks. Cousin Eddie, NT, no telling who else...

The money in the Forge checking account is a paper trail until it is cashed out of the account. IMO, the bank account may have had a mechanism that would cause the account to be frozen if certain amounts were withdrawn. I don't know the protection parameters BOA puts on business accounts, but IMO, there was probably something that would flag the fraud department about activity.

IMO, AM knew this, and $50k seems like it was the winning number.

Also, AM writing the checks to Cousin Eddie, if an audit of the account were to occur, AM would probably claim that Cousin Eddie was the client and it was Cousin Eddie's money....

Just a thought. I am very familiar with how trust accounts work for attorneys. I have first-hand knowledge and experience.

Except Forge was not a trust account. The trust account was held by the law firm PMMED where he was a partner. Forge was nothing more than AM dba Forge, and the bank account opened at BOA. MOO

To play devil's advocate -- He should get a discount buying lots in bulk, but if he only had one connect, and they see some dorky old white man then they may have inflated the price. If he had paid an astronomical above market price once, a dealer may have opened the faucet and continued to charge that astronomical amount seeing a sucker who was willing to pay it without questioning the amount.

Certainly makes Gucci purchases look like a drop in the bucket by comparison.
