Most murder cases are tried and won based on circumstantial evidence.

Direct evidence is usually a direct confession, eyewitnesses to the killing or recorded footage of the crime taking place or proof that the suspect was at or near the scene of the crime at the time of the killing.

Circumstantial evidence includes: murder weapon, blood spatter, fingerprints, DNA left at crime scene, basically any kind of forensic evidence which requires inferences as to what happened. Digital evidence such as online searches, phone records, phone pings, GPS or On Star car data etc is circumstantial but also proving to be extremely vital in a lot of cases tried over the past decade.

It's important to acknowledge that circumstantial evidence is given equal weight under the law. Eye witness accounts are notoriously spotty, confessions can be extorted under duress and so on.

Probably the closest thing we've got to direct evidence - which basically means stuff that cannot be disputed as to the facts - is the Cash video. The Cash dog tail video taken by PM firmly establishes that AM's alibi was a lie and that he was at the kennels at 8.44pm. The defense has had to belatedly admit this, due to the strength of this fact - his voice can be heard speaking on the video and proves he was there mere minutes before both of the victims' phones were locked and basically went dead forever.

Seems they think it should be like a CSI episode, if there’s not that smoking gun, video, dna etc then you have to not convict. The lies and timeline is the smoking gun in this case Moo
Well, that’s what worries me about people, ie: juries. Those people are out there.

I was thinking it's a shame Waters didn't bring this right up close of the day, but that would have given the defense the weekend to try to recover. Now they have to do it on the fly.

They've got two flimsy experts lined up.

I may have missed this or misunderstood this? At any point when his pills were found by MM or PM did they destroy them? Did AM admit to being in withdrawal on June 7, if so that is probably the motive.
He said he was in withdrawals on the 6th

One amazing moment on reflection, was when questioned on cross towards the end, when asked by prosecution - so you have basically had a successful career? Defendant was IMO stammering all over the place and couldn’t even answer that. Wow!

BAM! SGT Daniel Green body video: he asked: last time he was here with them or talked to them.... *earlier tonite..: answer: he left, dont know exact time, was gone for about 1.5 hours at his mom's...and saw them for about 45 minutes before that.*
all the excuses for lying about the timeframe and movements, namely his mistrust of SLED, they had not talked to him yet, this was all before GSR test, no inquiry about his relationship with his wife and son...the mistaken David in his friend's court case, which the pill paranoia would cause him, that which he opines over and over again....ANOTHER LIE OF A LIE ooh my...... those factors were not present. side note: look at his face...I swear his features morphed into pure evil when he was listening to himself lie in the last audio.

I'm not particularly enamored with AM's politeness, i.e. "Yes, sir", "No, sir", "Mr. Waters", etc. That said, I think some jurors might be smitten by this. How could this polite, well-spoken man have committed such a heinous crime?
It's automatic speak, how he was raised. Show a bit of respect and you can get away with more. There are Sociopaths I have known who act like this, but will stab you in the back if given the chance. Always ask questions, do inquiries. The more information you have, the better decisions you will make. Therapist would look into what made him hte person he is today. What life events, experiences of all kinds...Overall, it's sad, as he obviously is a smarty guy, but many very smart people use their smarts to commit evil deeds. Such a pitiful waste.

Ummm...Yes. I have many family members that talk EXACTLY like this. They have this same drawl, nicknames, interesting phrases, etc...Many people upthread from around the general area or parts of the South have also chimed in.

I find it interesting how many people think it's made up or some fake cartoonish thing. There are many parts of the world with different accents so pretty good odds he wouldn't sound like this if he were from New Jersey or Australia.

ETA- You should visit the South. Some of the most polite, respectful and pleasant people you'll meet. It's a different culture

However, I think some can "milk-it" if need be.

And, many southerner's have this amazing skill of slapping you in the face with just a phrase AND you don't even realize it 'til ya' get back home ;)
