Justice Toal ruled on Jan. 16 that she would be using the legal standard and precedent set by South Carolina vs. Green, a 2020 S.C. Supreme Court decision that requires that actual prejudice must be proven to get a new trial.

This means that improper contact or improper conversations with a juror alone may not be enough to grant a retrial if there is no evidence the juror or jurors in question were prejudiced into making a decision.

The presumption of prejudice by improper contact "is not the way to examine this issue, but with specific evidence," said Toal

I have a feeling AM isn't going to be getting himself a new trial. What BH has done in regards to the book is bad, but I don't think she tried to coerce any of the jurors.

FITSNews seems to be suggesting some impropriety with the fact that the AG’s office is prepping Becky Hill for this hearing. They spent several hours with her this week apparently, according to their sources. They say the AG office has a conflict of interest and they shouldn’t be investigating this issue. That their interest is in maintaining the verdict and not getting to the truth. I don’t know why the AG didn’t just pass this investigation to a different LE agency for the sake of perception.

Well, SLED already is doing 2 investigations that involve Becky Hill. How many other LE agencies would Will Folks like to jump in on this? Who else would have jurisdiction that Will wouldn't consider to have a conflict of interest?

I'd like to know (directing this towards Will, not the OP) what evidence Will has of what exactly the AG's office is doing in these meetings with Ms. Hill. They are one of the investigative bodies--they could just as well be doing some final questioning that Judge Toal wants before the hearing. I really doubt he has any insider source at the AG's office--from what I've seen in the media there no love for WF in the AG's office.

I think the AG meeting with Hill in prep for her testimony Monday is appropriate. Even Judge Toal said so on Friday. Harpootlian said he is NOT alleging Creighton Waters or any of the attorneys are doing anything inappropriate. So it does seem like Will Folkes is just dramatizing this meeting between prosecutors and Hill.

I guess SLED investigating this issue of jury tampering is the problem that defense continues to raise and Folks is also raising. Defense wanted the FBI to do it. I think if SLED asks for it or the AG asks for it the FBI would have jurisdiction. But ultimately, defense attys don’t get to pick who investigates cases. If jurors make allegations against SLED’s professionalism and ethics that’s a diff question. But absent that I don’t see how defense can pick and choose who investigates what. JMO

Interesting. Maybe whatever the first juror said was strong enough to make Justice Toal see clearly which way this is headed.
Concerning Will Folks and just my opinion, his credibility is on a free fall right now. He is blinded by jealously and bitterness and is only interested in discrediting other journalists. I’ve already canceled my subscription to FITSNews.

I don’t know much about FITSNews/Will Folks but there seems to be a lot of drama between Will Folks and Eric Bland. Lol. Eric Bland snitched on Will Folks saying he was tweeting from the courtroom before the juror was questioned and shouldn’t be allowed inside the courtroom on Monday. It didn’t work, apparently. But wow. A lot of petty squabbles going on by all these ancillary characters in the Murdaugh saga. JMO

I know Judge Toal said this wasn't going to be a broad fishing expedition of BH's entire life, just the part concerning the influencing of juror(s). She said she was going to be the one in charge of asking the questions, and thought that was strange at the moment. This should be interesting.

I have a feeling she is going to keep a tight rope on DH and JG, and the State too.
