Anyway, looking forward to what happens on Monday.
I'm not. I cannot believe that this case, with the clear cut, indisputable evidence present, is at risk of a non verdict. I know I shouldn't be surprised at all, I mean, holding LE accountable for their crimes is a near impossible task in this country, but FFS!!! This is absolutely sickening and shameful. And I feel for the other jurors, if they were making a sincere effort to bring justice for this victim. What a slap in the face for them as well. This shouldn't be allowed to happen. I don't know the answer, but we cannot trust the general public with LE jury trials.

I've been in the 11-1 situation in a jury room; we started at 6-6 and after two days we were 11-1. The lone holdout was to the point where she just clammed up and refused to say anything.

We came back the next morning and she spent a few minutes screaming obscenities at us. After that, she voted with the majority.

I have not read all the posts or articles about the jury being unable to reach a decision. I find it hard to believe the judge would state the division of the jury before deliberations are over. Can anyone direct me to the source stating the judge did so. tia

This is becoming apparent and even with a legitimate verdict here and there too many are walking away. And even if it's encouraging when they don't how long do we have to wait for justice to be the norm?

Something needs to change.

It was in a note that the foreman sent to the judge (the judge read it in open court).

“It is just one juror,” the foreman wrote in a separate note to the judge. “That juror needs to leave, he is having issues.”

3 notes to judge...one indicating this lone juror...and that all the rest had been in agreement for some time...in fact as I recall the foreperson asked for this juror to be removed. Also a note from the juror in question indicating they were not changing their mind...I know the judge does not want a mistrial but all of these people going home over the weekend puts a risk that something will happen...I mean their families etc. know they are on this jury. I think they will return...same situation and at least it will be early in the day and they may hope to keep the public reaction under control. This is a very bad situation with everyone knowing so much information in advance of the announcement.

I was watching CNN and they said if it's a mistrial, it will be tried since it's an 11 guilty. They say the holdout may be a stealth juror.

A stealth juror or rogue juror is a person who, motivated by a hidden agenda in reference to a legal case, attempts to be seated on the jury and to influence the outcome.

I think it very unfair to say this juror is "stealth" just because they don't agree

Not sure if the post means 11 jurors were in agreement for sometime to convict or if 12 jurors were in agreement to acquit then 11 changed their mind?

I tend to disagree. Charleston came together strong immediately following the Emmanuel 9 shooting. If there is any trouble following the verdict, it's my opinion that it will be from outsiders who plan to be here anyway.

as it was read 11 are in agreement guilty of something...the one juror is for not guilty...that is how the rumors are going about stealth juror etc.

Judges should be allowed to have a vote if only 1 person has been holding the jury hostage for whatever reason.

Especially when its a open and shut case caught on video while the officer is clearly trying to stage the scene.

Or at least let them find him guilty of the manslaughter and retry him on the hung murder verdict. Idk

The defense has asked the judge for a directed verdict of not guilty at least twice in this case - can the prosecution ask for a directed verdict of guilty, given the 11 - 1 decision so far?

well I bet that defense and Slager had quite a weekend! They are holding their breath that this one juror did not change. I bet they come in and I believe they had more questions but it should be cover within an hour.

No. A judge can only direct a not guilty verdict, not the other way around.

Jury has a list of questions - most of which sound to me like questions the judge will not be able to answer.

Defense is once again urging its motion for mistrial.

Can't help but wonder if money is playing a role in the mind of the one juror.

The city of North Charleston reached a $6.5 million civil settlement with Scott’s family last year. In the wake of the shooting, the city also asked that the U.S. Justice Department conduct a review of its police department policies with an eye toward how the department can improve its relationship with residents.

Would people try to rationalize that if the family received that much in taxpayer money, what is the point in sending the cop to jail?

That would be irrational to me, but justice as per the criminal code does not seem to prevail in such cases. Jmo.

No, prosecution has to prove their case to the jury.

This is a first for me as well, I have never seen judge state the division of a jury while there is a possibility that deliberation will continue.

The judge in the trial of the former North Charleston police officer charged with a motorist's shooting death denied a defense motion Monday morning for a mistrial.

Judge Clifton Newman said the jury has asked questions about the difference between murder and voluntary manslaughter, the definition of malice aforethought and the length of time malice must be considered to exist before a jury can conclude a defendant can be guilty of manslaughter.

Newman said one of the notes from the jury indicated the jury was "undecided," meaning they may not be deadlocked.
