Baby Andrew: Theresa Bentaas appears in court, trial date set


A Sioux Falls woman accused of leaving an infant on the side of a road in 1981 was arraigned on murder and manslaughter charges Monday morning.

Theresa Rose Bentaas was read her rights at an arraignment in Minnehaha County Monday morning in front of Judge Natalie Damgaard, and she was advised of the maximum possible punishment of her charges should she be convicted.

Bentaas is being held on a $250,000 bond, and has pleaded not guilty to the charges.

Bentaas' case was assigned to Judge Susan Sabers, and a trial date was set for June 10, though that date may change as the case moves along if attorneys file motions and delays.

Judge gives Baby Andrew murder suspect better shot of being released before trial


A Sioux Falls woman accused of leaving a newborn baby in a ditch 38 years ago has a better chance of being released until her trial.

A second circuit court judge adjusted a cash-only bond for Theresa Rose Bentaas, who is facing murder charges in a decades-old homicide case, to cash or surety, which allows defendants to work with a bail bondsman to post bond and be released while their case is pending.

Bentaas made her case in court for a lower bond Tuesday afternoon. A judge adjusted her bond from $250,000 cash-only to $250,000 cash or surety, allowing Bentaas to work with a bail bondsman to possibly post bond and be released from jail until her trial.

If Bentaas is able to make that bond, she would have to abide by court-ordered conditions. She would be required to wear a GPS ankle monitor, hand over her passport, check in at her attorney's office once a week and live with a family member.

Bentaas is scheduled to go to trial in June. She was charged in March, after police used DNA testing unavailable in 1981 to build a family tree and connect the case to her, according to court papers.

Plead not guilty. $250K Cash only bond changed (4/30/19) to $250K cash or Surety bond.

The last case ends up being the biggest for a Sioux Falls detective
Detective Mike Webb said he had many major cases throughout his 25 year career with the Sioux Falls Police Department, but his last case ended up being the biggest. It was a 38-year-old cold case that was pieced together as he retired in February. He had been working on it since 2009, but things didn't really start to come together on it until 2019.

"When I see a big case on the news, you still have that feeling you want to be part of it. You want to be there with your partners and solve that case," he said. "There’s a lot of excitement in that job and a lot of satisfaction in putting the puzzle together."

But his last puzzle he put together was the biggest one of his career.

"There’s a weight that comes off you when you don’t have that any more, and maybe push those thoughts aside of what you’ve seen and dealt with the past 25 years and having freedom," he said.
