Personal files?? There's the files on record- aren't they good enough? Wonder what's she's up to. Not the "shot first" baloney that the ME at first stated?

This is getting messy.

And what on God's Green Earth good could Flores files do at this stage of the game? His testimony was relevant to the guilt phase and she was found guilty with aggravating factors. That is all that has relevance now--the fact that she was found guilty. There is no legal arena now to challenge that other than the appeasl process.

Certainly JA cannot believe she can challenge the guilty verdict or any testimony that might have paved the way for that now, during the penalty phase. And certainly the judge will not allow anything of the sort. It is supposed to be only about mitigation now. The level of suffering of her victim is a proven fact now so I do not see how Flores or Horn or any of the others that JA claims lied under oath can have anything at all to do with this penalty phase. I hope JSS will not allow too much nonsense to go down. I do expect some nonsense though because I believe most judges would feel inclined to walk on eggs around a convicted person who is acting as their own counsel to fight for their life. I do not agree it should go that way but I expect it will.

Herein lies the problem. The judge should have made it perfectly clear that if she is granted her choice of wanting to be her own attorney, there is no going back and changing mind before, during, or after the proceedings.

I predicted a couple weeks ago that Jodi would try to change her mind once she realized how bad she will do. I never expected she would try to change her mind before we even get started. This is BS. I think the judge is not doing something right. I dont know what, but this crap should not be happening right now is all I know and it should have been prevented somehow.

I think the judge is allowing the convicted murderer to change her mind about self representation because if JA requested counsel at any point and the judge denied her that, it would open up a huge legal issue down the road. Might even get a verdict reversed on appeal. And then it would be another do-over. Sometimes judges have to rule in ways that look like they are being weak and giving in when in reality they know that ruling another way could raise eyebrows with appeals judges.

JMO because, really, I do not know about this for certain.

Oh, Curious, Arias warned of both what you quoted and what I did. She is a double barrel threat. Abuse or attack. I didn't mean to correct you, just adding some thoughts. What she is telling the court today puts a very frivolous cast over her petition to serve as her own counsel. She didn't really have the ambition to represent herself, she was just making a ploy. In all of this, I see a lack of respect. Among other things.

I've posted this before This is the "new" private practice that was going to bring him more money than a court appointed attorney. Now we know why he was so nasty during Jodi's trial. I wonder how many time he has his "clients" go over their crimes. Most "crime" listed have to do with sexual assault and molestation of children and minors.

I understand, however, there has to be some legal grounds and legal precedent for this in past trials. I am sure other defendents that have chosen to become their own attorney sometimes get cold feet during the proceedings. So, I think the judge could legally stop this nonsense regarding Jodi's "THREAT" by basing her rulings on past trials.

Its either you choose to be your own attorney and are granted that wish OR you dont. Period. Otherwise, Jodi could be her attorney for weeks and weeks and on the last day, just get up and say she cant handle it anymore and wants to give up her role and wants an attorney now.

I still think the judge is not doing something right about all this.

Furthermore, and this is important, there comes a point where the judge is bending so much and allowing so much crap to happen that the judge herself is causing more + more grounds for appeals. I firmly believe the judge has allowed so much crap and delays in this trial, that the judge herself is opening this case up to legal appeal issues.

I agree JA could go all the way to the last day or so with this and then announce that she cannot proceed further as her own counsel. This is exactly why I do not want JSS to release Nurmi at this point. Keep him involved so that no matter when JA plays the "I can't continue to represent myself" card the proceedings can continue without fanfare and without delays.

I am curious, though, as to whether any past defendant was denied counsel at their request after they said they wanted to self-represent. I would like to see cases of that being denied where the denial stood the test of time.
Because my view of our justice system is that one side has more responsibility while the other side has more rights. My take, therefore, is that if such a denial happened and were challenged it would be more likely to be ruled in favor of the bad guy than the other way around.

Other dp trials have moved along,what makes this so difficult,I think the judge is over doing it,and just may cause appeals that she is trying to avoid,I get it,they have to be careful,you expect delay after delay after delay,but enough already,put it to rest.

What I enjoy most about your posts since the first trial is that you saw this coming. You made a post in which you stated the obvious. She has no respect for the court or for counsel. It seems your posts reflect your giving all this a great deal of thought, whereas my posts just reflect my extreme anger towards Jodi. And just think. I am not even the victim or a family member. How must they feel?

Yes I have believed it was a ploy and I readily admit I am cynical about this trial. I do like Juan Martinez though and do believe he is trying. I hope he will use those after verdict interviews and I hope the judge allows it. I am just not sure about the outcome.

I didn't feel corrected by you. I was impressed by your memory! I am getting older and I remember most things vaguely. What I do know is that she stabbed the victim repeatedly, shot him and slit his throat and lied and delayed and put his family (and hers) through hell, even his grandmother who raised him, and I just feel no sympathy for her.

Oh my goodness. Is this for real? This sickens me. The criminal is allowed to do whatever she wants? She is the most manipulative and barbaric thing ever.

What is this Judge doing? I've had mixed emotions about this Judge but this is just too much. This is not the kind of Judge we need when dealing with a death penalty case and that too with a creature like Arias. This is an insult to the victim, his family and to Lady Justice Herself.

I am just speechless at all this circus-like chaos.

I am honestly scared that if this Judge is allowed to decide the punishment that she will choose life with parole. That scares me out of my mind.
