I am really tired of how they are using the name T-Dogg to make Travis look mean and intimidating. It was not uncommon a few years back for people to do that dogg-thing with their name, or their friends did it as an endearment of sorts. I recall the TV show "American Idol" where Randy called everyone "Dog" for at least one entire season. He was not doing that with derogatory or negative intent. I sure hope there is at least one juror who remembers this was the trend of the day, was considered cool, and was never in any way something dark, ugly, or toxic. That juror can educate the others, if need be.

My LDS friends keep telling me that the church is continually growing and many of the views about women have changed dramatically in the past 40 years. I found this recent news story that supports this.

"Mormon women with children and church members who remarry after divorces now are eligible for full-time teaching jobs in the faith's seminaries and institutes of religion for junior high, high school and college members."

My (non-LDS) Grandmother had to quit her teaching job (in the mid 1940's) to have children. She was able to return to teaching in public school in the late 1950's in Idaho, as the rules/laws had changed by then to allow "married women" to be teachers.

I do have to agree with my LDS friends that the church is slowly changing it's paternalistic views about female members, but they certainly are a few decades behind (IMO).

Is this type of smear campaign a bonafide mitigator? IOW, if he used profanity and engaged in phone sex with her, does that in any way mitigate the level of cruelty she imposed on him? I am not even talking about outweighing the cruelty...but rather is it actually mitigation on any level at all?

Not being snarky with my question...I would like to know if this sort of thing is typically done in penalty phases and if so, is it ever successful?
