"...Late Friday, the defense filed a Sentencing Memorandum asking Judge Stephens to sentence Arias to Life with the possibility of parole after 25 years. They cite 60 cases where defendants were sentenced to the possiblity of parole and give three mitigating factors: No prior criminal history, No propensity for violence and Mental illness...."

feeling awful. woke up crying not sure how i will endure it all. hydrodocone helps but added a xanax every now and then. doc appt. tues. for those of you wishing to visit and bring me cookies, puddings, etc., cancel your plans - haven't had a shower since last sat. gross! but finally brushed my teeth today. will have a bath tomorrow!

Apparently, this is all the defense has for sentencing when it comes to defending JA. It certainly isn't much.

Still no indication of remorse by the killer. They refer to mental illness, has no priors and claim she is not violent and not a threat to society. Sure. Right. A psychopath is not considered to be mentally ill it's just the self-proclaimed goddess' state of being dontcha know . The world witnessed from the day of her arrest to today her evilness just grow uncontrolled. Having been given the leeway to display her evilness in court, like a vampire's thirst for blood, her own wickedness is life sustaining, she actually thrives on it as we've seen her laugh and be unaffected by it all.

So the DT has 27 comparative examples of murder cases they claim are similar and by which they want JSS to guide her decision for release after 25 years. Well, 25 of these cases are violent murders committed by males and most aren't premeditated. If they want to compare her to male murderers, why not sentence her to serve time in the male prison. We know she'll get her kicks there and we do want to keep her happy don't we.

I also will be working Monday. Not wasting a vacation day on her, what if sentencing was delayed for some wacky reason. Anyway, Have IPhone will travel with me, with charger and ear buds. Can someone tell me if you can live stream from a phone. If so that is what I will be doing. If not, WS is my friend.

wow...listening to the motion Juan brought before the court just before verdict to dismiss juror 17. He outlines very factually that juror 17 did in fact go on internet to like certain arias related news...he even shows the timing that she would go there right court. She was liking things etc. It would take 2 weeks to have it confirmed that she pressed the link. JSS is woefully ignorant on social media and in this day and age that is not acceptable. Her questions indicated clearly she does not understand most of what Juan put in motion. Juan was bringing this motion for 2 reasons..one obviously he knew at that point (should have known much sooner) she was a big problem and likely to hang the jury and (2) it could be an appeal issue if they decided death. JSS denied the motion and the rest is history. At this point if JSS did anything other than lwop on Monday I think there would have to be some judicial review. It is no wonder that everyone was so confident that her life would be spared. watching this adds insult to injury. If JSS had granted subpoena to the state and further investigation had gone down it is highly probably she would have had more than enough evidence to strike her off jury...2 weeks considering the time already put into this trial is just nothing. Can't wait for this to go away.

Also...they require that a jury be "death qualiied" (sort of a joke if you ask me) but are judges "death qualified".....I think it is possible that some judges are not for the death penalty and probably should not be on the bench for those cases. Again all self reporting which really does not work.

Still listening to this hearing on motion to strike the juror...willmott argues even if you know they are lying when answering you have to go with their answers. On top of this one of the arguments is that not only is 17 on facebook daily but it seems that a number of jurors back in Feb. friended each other so a number of them were on there purposefully and therefore willmott argues you can't single out certain jurors. In my estimation this self reporting does not work. Juan did not even get into his relationship with 17's ex husband and father of her children. JSS is ruling quickly on this and summarily dismissed this motion...I think she knows 17 should not be there...and was on jury thanks to her own actions...her only recourse now is to give max sentence.

Apparently, this is all the defense has for sentencing when it comes to defending JA. It certainly isn't much.

.........and the defense continues to "blah, blah, blah."

CMJA wasn't given a plea. She didn't have a previous record because no one filed anything about her "stalking behavior" or witnessed her slashing TA's tires. We never heard directly from her first 2 boyfriends. I don't give DB any credence, I think the man has some "issues", including the inability to tell the truth. Anyone who "knew" her had no problem getting their 15 minutes of fame via MSM, but refused to testify, citing "threats". BS. You don't go on National TV, and expect anonymity.
Her family never got up in her behalf. They KNOW she's messed up. They probably feel safer she's locked up.
It wasn't a crime of passion. She sought out her ex boyfriend who she had been estranged from for over a year. She drove a thousand miles. She brought a gun. She disguised herself. She covered it up. It was about as premeditated as you can get.
Every case is different. None of the cases cited in the defense's argument say whether there were "other charges or cases" that their examples where also convicted on besides the ones noted. They didn't base their case on the "guilty but insane" plea. If she's THAT mentally ill, why didn't they? Because borderline is not a justifiable excuse for murder. Because her "PTSD" is a fairy tale.
It was not domestic violence, they never lived together as boyfriend/girlfriend, or even husband and wife.
She was a social climber and a woman scorned.
Too bad TA didn't get the upper hand when she attacked him............

I just went through this, and my heart goes out to you. Never thought it could hurt so much as Tobi was sick for a while. I am still trying to find my new normal, one thing that has helped a bit is to reach out to Pet Grief Hotlines. Tuffs has one, and there are several out there. We go through all the emotions, denial, grief, anger, guilt, etc...I am slowly working through them myself. Reaching out to caring friends really does help.
