Condemned man's second thoughts about execution gain no traction

"Richard Masterson's lawyers told him not to testify, but the newly convicted Houston capital killer wouldn't listen. Under questioning by the prosecutor, he told jurors they would send him to death row if they followed the law and that he likely would become violent behind bars within weeks. Jurors took him at his word and sentenced him to die.

Now, after almost 13 years on death row, Masterson, 42, has changed his mind. In a recent petition to the 5th U.S. Circuit Court of Appeals, Masterson charged, among other things, that his lawyers provided an insufficient defense by failing to develop and present mitigating evidence in his trial's punishment phase. A three-judge panel of the New Orleans court on Friday rejected the appeal.

Masterson was convicted of the 2001 murder of Darin Honeycutt, 35, a female impersonator known by the stage name "Brandi Houston." Testimony indicated that Masterson left a Montrose bar with his victim, then robbed and strangled him. The victim's friends found his nude body in his Montrose apartment two days later. Masterson later was arrested in Florida..."

State has enough drugs to carry out scheduled executions

"With the first execution of the new year scheduled next week, Texas prison officials said Wednesday that the state has a large enough supply of drugs to carry out the executions already scheduled for 2016.

The Texas Department of Criminal Justice has been forced to find nontraditional suppliers of execution drugs in recent years because the usual vendors refused to make their drugs available following scrutiny from death penalty opponents.

The state was struggling to replenish its supply of the powerful sedative pentobarbital over the summer, but was able to obtain enough doses to execute six inmates between June and November.

There are nine lethal injections scheduled this year..

Condemned murderer Richard Masterson is set to be put to death Jan. 20 for the 2001 slaying of female impersonator Darrin Honeycutt in Houston. Masterson strangled the victim and stole his vehicle following the murder.

The Houston Chronicle reports that the Texas Criminal Court of Appeals recently denied a petition filed by Masterson's attorneys to stay Masterson's execution, bringing into question the findings of the medical examiner who performed Honeycutt's autopsy. The petition also stated that Masterson was suffering from withdrawal symptoms when he confessed to the murder to authorities.

According to the Chronicle, the high court rejected the petition because the arguments could have been brought up in previous appeals. Masterson's attorneys plan to file additional appeals at the federal and state level.

There is one more execution scheduled this month, one in February, three in March, two in April and one in June."

Alabama Inmate Seeks Stay Of Execution Following U.S. Supreme Court Ruling

"WASHINGTON — Just six days before his scheduled execution, the lawyer for Christopher Brooks has asked the Alabama Supreme Court to put Brooks’s execution on hold so the court can assess whether its capital sentencing laws remain constitutional following this week’s U.S. Supreme Court decision striking down Florida’s capital sentencing scheme.

Alabama, like Florida, places the final decision of whether to impose death on the judge — not a jury. On Jan. 12, the U.S. Supreme Court held that “Florida’s sentencing scheme, which required the judge alone to find the existence of an aggravating circumstance, is therefore unconstitutional.”

Since that ruling, Alabama officials have defended their state’s law as having been previously upheld as constitutional and as being distinguishable from the part of the Florida law struck down this week. Criminal defense attorneys have said otherwise, and now — in Brooks’s case — one of those lawyers is asking the Alabama Supreme Court to step in.

“Mr. Brooks’ death sentence might be unconstitutional under Hurst v. Florida and, if it is unconstitutional, he is entitled to relief,” the lawyer for Brooks wrote, referring to this week’s decision. “Mr. Brooks’ death sentence should not be carried out while critical questions concerning the constitutionality of Alabama’s capital sentencing scheme remain unanswered.”

Brooks was sentenced to death in 1993 for the 1992 murder of Jo Deann Campbell, a sentence imposed by Judge James Hard. The jury had recommended a death sentence to the judge on an 11-1 vote..."

A Really Short History of the Snowman

"Well, all right; snowmen and snowwomen have been around for much longer than the memories of anyone alive today. In fact, you’d need to have a Methuselahan memory to even approach the dim early days of characters made almost entirely out of snow.

The problem is that in any given year, we hardly get to know the denizens of the front lawn or sledding hill before they’re off in the vapor; usually without a fare-thee-well. Unlike the season of their visiting, there are no flyers trumpeting their pending arrival, no countdown to their visit and no TV Bio’s to give us a deeper understanding of their heritage and ethnicity.

It’s kind of like the people you know from church – you see them every week (perhaps?) but you don’t know their name, where they live, how they earn a living, or much of anything except that they sleep during the sermon and always dodge out before the final prayer.

The English word history comes from a French word that means “story”. If you were to ask, “what’s the story of the snowman?” our response would be necessarily short because we haven’t spent enough time to gather the facts...."

Regarding the snow on Red Square, Moscow picture: I've been there, but when I went in 1977 - NO ONE could walk on the "Red Square" - it was guarded by soldiers; you had to walk around it. We went in the summer - no snow! :snowball:

My DH thought he was immune to all viruses as is he exposed to them all the time. Nope. He has had some laryngeal, hoarse, respiratory mess this week. The week before it was a GI virus. Thank fully, he is relegated to certain areas of the house. Mainly all of it except within 20 feet of me. I wear a mask or hide under the covers and hold my breath. Very scientific.

Poor boy! I hope he'll feel better soon.
And you, keep on holding your breath ;)
