I thought she was supposed to have a hearing at 11:00. SM's was actually a last-minute surprise to me.

The judge has to "look over everything" in order to make his ruling.

I couldn't make out exactly what else she said in that moment, but it was something along the lines of " I thought the whole point was to tell the truth."

The defense is arguing that Moorer gave the statement in violation of his Miranda rights.

The solicitor notes that Moorer went to the police department voluntarily and that his wife would pick him up.

The judge said he will take the motion under advisement.


I *think* that they are trying to say that he was "miranda-ized" initially when the previous interview took place (before the one we heard) so that would mean he was technically read the MR and may have thought to still be under them? I was a bit worried when I heard that part b/c I'm not sure how it works.

Sidney Moorer is heard saying that it was around mid-September that Heather Elvis began calling and/or texting him.

The defendant said he didn't know why Elvis called him that last time. Moorer is heard telling the detective that he couldn't see her anymore because he wanted to fix his marriage. He described himself as "happily married."

Moorer says he and Heather started relationship in September. Says he doesn't know why she was calling when he was with his wife.

Cheating on wife, not allowed to go anywhere without his wife, not allowed to have his own phone, and handcuffed to the bed every night = Happily Married. :lol:

Hearing was not on contempt of court charge for Tammy Moorer as previously reported. No word on that alleged charge.

Also, Thank you everyone for giving us the play by play! I'm stuck at work and not in a position to watch. It's killing me not watching but ya'll are making it easier

Moorer says Heather asked multiple times why he wouldn't leave his wife.

Moorer says he thinks he saw Heather riding by his home 4 or 5 times. Says that and the notes are why he wanted to contact her to say stop.

Moorer says Heather left a note on his car - "call me". Says that's why he called her on pay phone to tell her to leave him alone.

It's too bad Heather cannot give her statement as to what happened that horrible night. :angel:

SM says he went to Walmart that night to buy a pregnancy test for TM. If TM thought she might be pregnant, then why was she drinking two different kinds of liquor?

Ya know, almost 4 years later (:notgood:) I really have grown emotionally attached to Heather and am sure most of us here wish we could go back and warn her of that fateful night.
