So he was found guilty of second degree murder. Let's hope he gets life.

Both of those convicted in this heinous crime have been convicted of second degree murder.

I'm ok with that and REALLY hope the mastermind behind this, Mark Sievers, gets convicted of first degree murder. Is Mark's trial a death penalty trial?

This is what I found in an article. They didn't think he was part of the murder plan but that doesn't mean they didn't think he didn't help murder Teresa.

"Second-degree murder and trespassing were both lesser charges the jury could find Rodgers, 29, guilty of, taking the death penalty off the table. The jury could not agree that Rodgers was part of a plan to kill Teresa Sievers."

Yes it is. He can still get the death penalty. That’s why I’m wondering how today’s result is going to affect the trial, if at all.

It will play a part but there so MUCH more in Mark's trial. It is going to get messy with so many issues with what he did in life. JRR was the small part. Mark and CWW re T's practice and Mark planning the whole murder is huge.

I don't see how it will affect the trial at all. The men he hired were both found guilty of murdering the person he hired them to murder. Just because neither received the death penalty doesn't mean they weren't involved.

I really hope they don't complicate it too much for the jury. In Dan Markel's trial, Wendi Adelson wasn't even on trial and with the very limited evidence that was brought out in that trial convinced the entire jury (according to the one who was interviewed) that Wendi was guilty. Sometimes less is more.....

Mark made everything complicated. I am very anxious with what him and CWW were doing behind T's back re the medical practice. He was unethical in everything! A lot of twists and turns in this case.

Accomplice Felony Second Degree Murder occurs when you are an accomplice to a person who kills another human being while engaged in the commission, or attempted commission, of the following statutorily enumerated felonies, regardless of whether they intended the death:
  • Burglary (in this case)
Penalties for Second Degree Murder
The crime of Second Degree Murder is a First Degree Felony in Florida and punishable by up to life in prison, life on probation, and a $10,000 fine.

Second Degree Murder is assigned a Level 10 offense severity ranking under Florida’s Criminal Punishment Code. Absent grounds for a downward departure sentence, a judge is required to sentence a person convicted of Second Degree Murder to a minimum sentence of 16¾ years in prison, but may also sentence the person up to the statutory maximum of life in prison.

Lets see how much extra time he may get due to his probation violation. Waiting to hear back from AZLawyer on it.

It will be interesting to see what JRR’s sentence is. Since the jury didn’t think he actually physically hit TS, my suspicions are the jury will not give JRR more time than CWW plea bargained for.

Perhaps, even less time since CWW committed the actual murder. CWW was smart to plea bargain, as IMO a jury would have given him first degree murder.

Mark is the one that seriously needs a first degree murder charge! If it wasn’t for him, Teresa would be here today. As the Mastermind, how in the world could a jury give him a second degree murder charge! Teresa’s murder was preplanned, so doesn’t that throw it out of a second degree possibility?

But we know, never to say never, especially in Florida. :confused:

Because they didn’t give 1st degree, the jury is released and doesn’t help make that decision. The judge decides his sentence.
 
Yes, I came to the same conclusion! Without parole! That could easily get him 50 years altogether. Let's see what AZ thinks.

Not sure, if they use the PRR chart as min to max converter or multiplier. In other words, the mandatory sentence would be the max JR IMO would get with his charge and the judge has to go by that sentencing chart IMO. State has to prove JR is a PRR, but does not have to notify the defender they are going by this. - Or they go by levels and multipliers without the PRR, but adding in the federal parole violation..

Any way, I think JR will be put away for a long time. A very long time. Justice for Dr Teresa Sievers!

I'm reading on other places that a lot of people are having a problem with the judge and how laid back he was during JRR's trial. Comments include too much laughing/smiling, not being serious and how they think it affected the jury as it didn't seem he took the trial as a 'serious' thing. Sitting back and trying to think of how i'd be, I do think if the courtroom is more 'light hearted' you may not think this murder is as serious as it is. Again, WE know alot more, but for someone brand new, looking at 'young, bespeckled, clean cut JRR', and a judge all smiles, DOES that lead a jury to vote less serious charges? Hmmmmm. Sounds like a heck of a thesis for someone.
