VZ: If one looks at the telephone calls etc, one can see a clear involvement from the start. The indictment still reads that he was not involved.

VZ: This is an application in terms of Section 174. We deal, at length, with Tongo's evidence. Some of Qwabe & Mbolombo. He admits he lied. A lie within a lie.

The evidence to prove the conspiracy: In the main, it's the evidence of Tongo. All they (Qwabe and Mbolombo) can say is what Tongo told them. Nobody else. That is the only evidence before this court (Tongo's evidence). The whole case is based on conspiracy.

Traverso: I've got to say that there was at least some evidence to the conspiracy

. VZ: Tongo is the pillar on which the state's case is built. If that collapses, the entire case goes with it.

(Tongo) displayed several inconsistencies in his testimony. When presented with them, he simply said "it's a mistake".

There is no credible evidence on which to convict the accused, and we submit that is the test in this case.
