wow I didn't know he had to stand during this long proceeding.....he may faint....

T: This was clearly crucial, but in Tongo's affidavit, not a word was mentioned (between Dewani and Tongo in hotel after killing, re Dewani not asking him if hit had been done)

Then judge goes on to highlight how Tongo did not admit to receiving money in first version, and his conflicting explanations why he did not, later. Judge thinks it was simply that he was afraid of discrediting his entire testimony.

made a big deal about the plastic bag....denied that there was a card inside the bag, Judge says she can see something inside the bag.....(paraphrased on my part)

Judge also feels it is very suspect that Tongo did not throw away plastic bag inside hotel toilet, but instead walked outside with it?

Judge says Tongo 'kept on protecting' Mr Mbolombo, even when it was showed he 'clearly played a bigger role' than he'd said.

Traverso says Tongo's story is highly improbable.

T: Tongo at the airport was neatly dressed....on way to hotel offered to show them town...there could have been no indication he was anything other than law-abiding taxi driver....can this court really accept within 15 mins accused would approach him to have someone killed?

Judge now going into what pros Mopp said about witnesss does not have to be wholly consistent, but judge quuotes how case law says 'essential' story must be true.

Surely the same would be true of someone would risk his job, life etc to COMMIT a crime, not just HELP commit one?

.. so, if the judge thinks his testimony is so unreliable, why does she believe this? (i.e. that he earns R30K in a good month) .. he might well have been lying about that, too.
