State rests rebuttal case- thread #165

i don't see how he can refute anything Dr horn said. he is not an MD

A neuropsychologist usually examines people that are alive to assess cognitive functioning after brain trauma I.e. stoke, head trauma, illness. They also provide testing to get a better picture of that persons brain function.

An ME, a pathologist examines deceased people to determine cause of death. They have a large fund of knowledge about mechanisms of injury causing death.

The neurobiologist did not examine TA obviously, but may have a working knowledge of head trauma similar to that which TA indured. It will be speculation at most. IMO

I had used the link to donate that was the Travis Alexander Legacy Fund as it stated that the fund would be for the Alexander's. Then I saw where there was another link that the donations went directly to the Family. So I emailed Chris Hughes to inquire if the money actually went to the Alexander's. I finally received 2 emails from him although they were signed Samantha from his personal website/email: Raising You Foundation. It is my hope the family received my donation as it was a lot of money, at least for me.

I think in cases like this, there is a lot of confusion in the beginning because they're not professional fundraisers and they're starting with almost nothing. Suddenly the floodgates open with the incredible generosity of so many people. I'm sure it's overwhelming because one minute they're probably borrowing from their credit cards and 401ks and the next minute there's so many donations they can't get organized.

I think they're trying to do it all themselves and its just chaotic. Hopefully, they will get trustworthy pros in there to manage it and to keep volunteers honest.

I'm sure it's been a full time job.

In case this hasn't been posted yet, the state's got a new supplemental witness list filed (no. 17)

I had good intentions during the long weekend break from the JA trial to accomplish some spring cleaning projects. Then, a young Michigan mother went missing from her job at a gas station last Friday night, and I've become engrossed in the case that has a thread on the Missing Persons board here at WS. I haven't forgotten about the fast-approaching conclusion of the Jodi Arias trial, and I hope for a guilty verdict by the end of Friday. :please:

There will always be a case to keep us from what we're supposed to be doing.

We have issues.

because he is a media hound about made the rounds several times. because he had nothing important to say. because he was an extremely hostile witness and beyond infuriating.

I posted the comment about Abe, but not the stuff about Gus--so I'm not sure why you attributed those remarks to me. For the record, I thought Gus was obnoxious and his behavior on the stand was disrespectful to the Court. I was happy that Juan ripped him a new one.

I'm not sure if these are just rumours or what but according to the facebook page:

Dr. Geffner is a neuropsychologist and the def. want him to rebut Dr. Horn's testimony about the head wound. He will also rebut Dr. DeMarte's testimony about PTSD.

* There is a hearing Tues morning regarding a State motion [filed today]. I don't know if cameras will be rolling.

I don't believe these are rumors, as I understand it, they come from a defense motion to expand the scope of Geffner's testimony. They want him to refute Dr. Horn's testimony about the incapacitation that would result from a shot to the right temple which lodged in the lower cheekbone. Geffner is not an MD, certainly not a forensic pathologist, and any such testimony by him should NOT be allowed. Dr. Horn said it is simple geometry , and I totally agree with him about that. Obviously, the Defense could not find a ME to contradict Dr. Horn, so they are trying to sneak in an unqualified person's testimony in instead. This would be a huge mistake on the part of Judge Stephens. But I have no confidence in predicting her rulings, because she's made a lot of evidentiary rulings that are plain wrong.

Geffner has been criticized by a number of appellate courts for testifying to BS. It also appears that he no longer sees patients, so he makes his money by concluding that every murderer suffers from PTSD and battered woman's syndrome. Juan's cross will be most interesting.

Yep, the defense will drag this on until Friday, the judge said they would be working on Friday until they were done.

P.S. I'm supposed to be working. I have a lot to do. The threads are slow without trial and still here I sit. Eating Cheetos. Not good.

Zuri,

I understand your concern, the way I look at it... Once I gave, it's gone. I don't worry about it anymore. I think the family is going to use what they need and if there is anything left over... They're donating it to a cause Travis was passionate about.

Yes, and I cannot imagine this guy will be a better witness than Dr. Horn. I felt like Dr. Horn didn' t elaborate, he didn't try to add bs, he just told the facts.
Still, I can imagine this jury having 100+ questions for him no matter what he says, which I don't get, but they're in the courtroom every day, not me so who knows what they're thinking. I'm sure he will be able to find one study from somewhere which says just because a bullet goes through a brain doesn't mean they will get immediately incapacitated, or find one study out of millions where the bullet managed to not damage the brain in a similar situation.
But oh well, nothing we can do, it's all in the jury's hands.

Does the family have to give the money back or do they not get it all at once? TIA. this is really bothering me

Hi Zuri, the money goes DIRECTLY to the family, and if as and when the family has any money left over they are planning to use it to go toward the foundation for Travis' legacy, to continue his good work in his name. Since it is such a large family, and they have been effectively out of work, with bills, car note, mortgages, etc back home, not to mention the travel of the siblings, the aunts, etc that fly there and or drive there, all of their lodging, etc, child care for their children at home, normal household expenses back home, I doubt if there is going to be money left over. The reason I say this is Katie who I trust with all of my heart has said repeatedly, the family is having a very hard time of it, and appreciate any thing anyone sends, even the ten dollar gas cards. I don't want anyone to think there is this huge cash flow of money and Chris is using it for any reason other than what the donor intended. He has said, and I am sure Tricia can clarify, the money is going DIRECTLY to the family. Katie has said here, repeatedly, the money is going DIRECTLY to the family.

God bless all of you who have sent this sweet family money to help them. If I had to leave my job for five months, stay in another city, maintain my home and care for my children, etc I would not have enough of a savings to last very long. Not very long at all!!

I judge people by their actions and this family, all of Travis' friends and that certainly includes Chris and Sky Hughes have shown me by their actions that they are humble people trying to do the best they can by their loved one. Even the children with the lemonade stand touched their hearts. God bless you friend, and may God bless this family during this very difficult time. :blushing::blushing: The reason I am so sure there is no abundance of money is because Katie and Katie DDJ are working tirelessly, with a team of people, to arrange lodging for the family during the verdict watch. She has mentioned she has reached out to many businesses in the community to get some help. This tells me there is no huge pot of money with amount to give back or be misappropriated. So many folks here mention the humble, grateful letters of thanks they have received from Travis' sisters. I think the need is present and ongoing and the money you sent went to the right place and is appreciated!!!

One of the questions a neuropsychologist asks is to say as many words as you can starting with the letter "F". If you consciously try to skip over the F word, you are good to go.

Not me. I don't have any issues.Sure I think about this case 24/7. I've neglected everything else for this case. I have butterflies in my stomach thinking about this week but issues? No. I have a healthy interest. No issues. No obsession. :innocent:

You guys certainly do need some help though. :therethere:

This doesn't strike me as bad news. Could be the State anticipates a first-degree murder conviction and the supplemental witnesses will be involved in the aggravation and/or penalty phases of the trial.

I'm not worried about this defense witness. At all. ;)

No way they're cleaning this up. They could bring Mr. Clean AND Mr. Bubbles and not even come close.

Justice is coming.....

No, the Judge said they'd be working on Wednesday until they were done. I don't see her reversing course after spelling out this week's schedule for the jury before court adjourned last Thursday.

Thank you for the correction, for some reason I thought it was Friday.

A close friend went to a TBI rehabilitation center after a car accident left her in a 10 day coma. I visited her and met a man that had tried to commit suscide with a 25. He with left with global pervasive deficits..zero short term memory ability. He could remember nothing before 5 -6 minutes previous, motor skills were nil... could barely feed himself.

I remember the neuro doc saying he was lucky to be alive...was a miracle he survived.
