The search was on the 13th. No way he did that trying to make it look like it was Nancy. Was he going to suggest she snuck into the house to do it?

There goes that theory...

Good observation. I wonder why in the world he did do it then...

Yet he did neither.

I never believed that he looked at that suicide site with the idea of actually committing suicide but I'm sure he got some ideas about death by asphyxiation. MOO

He first wanted to get out of the house to avoid the cops and press by looking for a Museum trip with the girls.
Next, he wanted to jet off to Canada to totally remove himself. Remember the job search too?

Yes, and didn't he also include in those searches "things to do with the kids" even though he had plans for tennis. It is likely that his story was, she wasn't home yet, he took the kids out, and came back and lo and behold, she had searched flights and jobs and everything else. Add this to the contact with her ex- fiance in Canada, and we have a woman running away.....He didn't know she had plans in the morning, or why would she let him make tennis plans?

He had tennis at 9:30. He would have been home by noon at the latest.

But she had plans to take them to the pool in the afternoon.

I personally think they should call his entire MBA class and everyone who has ever competed in an Ironman with him. Just to get everyone's opinion in.

All the folks who were invited to their wedding should come to verify there was indeed a wedding. Heck, let's bring in Building #9 at Cisco, too.

Wouldn't that be something ... 8 days of non-stop witnesses talking about how they think Brad is innocent even though his marriage was on the rocks.

Let's have a "pool" to see how many days the defense will take to present their case. What is everyone's guess? :)

But the dress NC wore to the party was in the house. So was the necklace, her cell phone, keys.

But he could have been asleep? he couldn't even find the rifht dress, her cell was in the car, who is ti say he ever even knew if she came home? She could have left the party with someone.

I am thinking Kurtzie will pull some 'directed verdict' nonsense. Can we pull that side first?

I'll go with seven days on defense (it's Easter weekend, so three days this week and ending next Friday?

I keep going back to the M.E. testimony. That onion segment still in her stomach. Defense didn't counteract that factoid. An entire meal would be digested within 6 hrs. Every bit of food gone. Even an onion, which takes longer to digest, would be gone by then.

If you assume Nancy took her last bite of food at midnight, right before she left the party, all food in her stomach would be gone, out of her stomach, within 6 hrs.

Onion piece still in stomach at autopsy. Not contested.

Nancy was dead by 6am.

Found this info on a GI site, a study of transit time of normal meal through stomach:

- 50% of stomach contents emptied 2.5 to 3 hours
- Total emptying of the stomach 4 to 5 hours

I added in an extra hour for the onion, just to be on the safe side.

so what was the big story he told about their night/early morning, up at 4, calls for green juice, jogging, all about?

During the deposition BC's attorney objected many many times in the depo...and the next words out the attorney's mouth was that he could answer the question. They could have saved him at that deposition so many times and they did not do that.

And Kurtz was there. You wouldn't know it unless you heard the initial introductions, or heard him talking about the call the the judge. Why wasn't he more present? Is is because he firmly told BC no to the deposition, and he didn't follow advice, and Kurtz wanted to remain as distant as possible so as to not be criticized?

I was thinking six, with closing next Friday, but I'm a rookie. Never followed a trial before. EVER. How long do you think the close will take?

  • #695
Allowing Brad to be co-counsel is one of the biggest mistakes they are making. He's not in a position to see things clearly. MOO

He isn't co-counsel. Where do you get that from?

I have to say I think the closing argument will probably be longer than the defense case itself if they're smart.

There isn't a whole lot you can do at this point but play on the "bash the victim" angle.

Kurtz has 2 hired guns...telecom and computers.
His so called "eyewitnesses" to Nancy's jogging are probably not as certain, now that they know the state has evidence to totally discredit them.

I think it was sarcasm/speaking to the control factor.

I thought he was saying "Pull my finger, Howie. Pull it."

And if this is true, and uncontested, she certainly did not go running.

Fencers, what say you about this onion?

I was being a bit facetious. He seems to be directing his own defense.
