if he was on their list..wouldn't they already know if he qualified as an expert?

Palomine, why don't you ask them?

ETA: The state obviously doesn't want a defense witness to be considered an "expert" to support their case because he can be asked his opinions. That is why they are making him go through this.

I still can't believe you guys are blaming this on the defense. They came ready to do this in front of the jury, and the prosecution did a last minute motion in limine to do this without the jury. So, how exactly is this the defense's fault?

Maybe getting discovery 4 min. before court started this morning?? :waitasec:

Well, what a surprise, the first defense witness up and the majority here start the bashing of the witness as soon as he sits in the chair.

Double standards is almost too kind of a word.

Easy, now. Everyone is entitled to his/her own opinion. I certainly do not have double standards.

I think we all realize that the prosecution's case is tenuous as best. All it will take is one expert witness to throw reasonable doubt on their case and the jury will likely acquit. This is the reason for all the hyperventilating and nervousness disguised by humor.

This jury is constantly needing breaks? Aren't they on break when they aren't in the courtroom?

I don't think they're allowed to leave the jury room when they are sent out - unless it's an actual break time or released by the judge. When I served jury duty we were stuck in the deliberation room while the attorneys/judge discussed matters and worked on a plea agreement. We were not allowed to leave the room even for the bathroom.

The jury has been sitting in the jury room, waiting for court to begin this morning. Wish they could be made aware that the delay was caused by Brad and his posse.

The delay is being caused by the prosecution.

I hope the pros made note of what this guy is saying. IF he's allowed as an 'expert' witness, he just gave away the store, imho.

He said he's never worked at a system he couldn't get into. There's MANY ways and he was to find them. There's ALWAYS ways, and the attacker only needs to find one.

IMHO, that would mean to me, as a NON computer type, BC being an 'EXPERT' knows a way that no one else may to have gone in and done stuff and leaving NO TRACE.

In other words, BC can MOST LIKELY do ANYTHING this guy can.

The point is... the judge has to follow LAW. The expert witness has to have VERIFIABLE knowledge, training, and expertise in the field he is testifying in. He <the judge> can't just let any who-dad who SAYS they are qualified/experienced up on the stand to potentially taint the jury.
I see more kittens in the near future.

Not hyperventilating - actually barely breathing from boredom. In fact, I may be unconscious in my seat.
