Given Willoughby's slowww record to allow arrest, I am having trouble imagining him pulling the trigger too quickly in this case (this is the guy who waited 3+ yrs for Young and 5 years for Ann Miller).
I know, that is what has me puzzled as well. At the time, I just KNEW he had the smoking gun. Now, i'm not so sure.
Everything in the opening statement could be answered with reasonable doubt.
I guess we need to wait on the VOIP evidence, though Kurtz seems fairly confident he can cast doubt on that as well.

I'm watching yesterday's testimony of Diana Duncan and find it difficult to take her seriously with all of her nervous laughing. Also thought it was odd that she mentioned she & Nancy had "fallings out" from time to time and they eventually came to the realization that she (Diana) didn't need to be friends with all of Nancy's friends. That plays into Kurtz's discussion of the turbulence in the clique.

Again, not having seen any of the video, but in reading these comments I just had an idea appear in my mind. I too have been thinking that they have some pretty hard evidence given the LE and Judges reaction in the emergency temp custody order. They also moved to arrest with lightning speed, given the JLY and AM cases.

It may well be that the evidence they have is good, but now I am beginning to think that some of the biggest evidence might well be some of the things that BC said and did, his statements and actions when LE first became involved.

I remember that when I first heard that a lady was missing and friends were looking for her, I was out in the woods that weekend with my kids and not knowing that there were organized searches going on, kept an eye out for anything that might have looked out of place. Stuff like, bodies ;), discarded clothing, etc. It was only 2 days after she was reported missing that the local media even mentioned that she was married. This immediately moved my hinky needle. Given the reports initially, I had assumed that she was single, having heard no mention of kids or spouse.

From what we have pieced together, BC acts a bit like an odd duck. He was also under stress with LE and friends all over asking questions. I think it is highly likely that he had a hard time keeping his story straight and may have contradicted himself several times, and/or told stories that made no sense. Like, oh, I don't know.... vacuuming a car trunk to remove a gasoline spill??

I know, dcnc. I know that some people do have a nervous laugh, but I prefer decorum in the courtroom. Had Nancy been my friend, I would certainly have a very serious demeanor on the witness stand.

Not that it matters, but I also find it rather odd that Diana Duncan included the periodically 'falling out' in her testimony.

Just me, though.

But the tarp wasn't used. So who cares that it was purchased the day before. If he bought it because he planned to kill her, then why didn't he use it?

Tarps are really loud and crunchy-sounding. Maybe it's possible he started worrying about waking the kids?

I also have to wonder why he wouldn't want Nancy to work. She was working before they moved to NC.

But at the end, he was tightly controlling the money situation and didn't want her having any spending money. She was wanting to move back to Canada with the girls.

Almost sounds like she's been influenced by someone, doesn't it?

... I was commenting about what LaLaw wrote, not about what I am now hearing live. She just sounds nervous.

I am surprised how much 'hearsay' testimony is being allowed in this trial.
Usually the parties (one side at least) fight to keep the victims statements out, very odd... anywho, here is the linky for anyone that doesn't have it already but would like to watch it online.

Not sure if we area allowed to give full names. She is Diana D., Nancy's neighbor who lived across the street. BTW, she is the one you can hear clapping on that news video where Brad was arrested at his home.
