Gotta hand it to Kurtz - he keeps trying to bring in that statement by Bella. He is confused though as he admits in his opening that Brad said Bella didn't get up until 8:30 and they had breakfast.

Thanks, hot - that's a big one. But I must agree that it would just loom too large, IMO. The days are so similar for the very young (and very old, probably). I think that what she has been reported to have said would not be considered by some to be just the willingness to please, or just the "young-ness" of a four-year-old. Plus, wasn't she asleep during all of this?:offtobed:

I know we still have not heard nearly all the testimony, and the video blackout is getting very old. A GREAT BIG tip o' the hat to Sleuthy Gal for risking p-knewmonia in the cold courtroom today to bring us the scoop.

I know the last tweets, which have been few and far between are not sounding all that great for the prosecution: "it might have been like this..." but keep in mind, they don't have to prove HOW he did it...(It was Col. Mustard in the Library with the Candlestick!) just if he did it or not.

The burden of proof still falls on the prosecution. They shouldn't be able to convict based on peoples feelings. They better have a theory about how he did it and have some evidence to back it up.

Gee, the defense claimed this did not happen...

I assume the defense is going to bring all 16 people in. I know the woman that testified at the custody hearing was 100% positive according to her testimony. So that contradicts what this officer is saying.

I know that Carey C. said Nancy cancelled her running plans on Fri. morning and said she (NC) may go to the gym later in day to do something else. No one has said what she was wearing prior to the green sundress, right? Just wondering if she had on exercise gear earlier in the day and if it was black shorts, white shirt?

Add to that the time Brad had the girls alone before he returned home that afternoon - power of suggestion?

And the defense is the one that asked the question in order to get that response. Are you guys sure he's good?

Obviously they had a reason for asking that. If they bring in witnesses that say the police never contacted them, it impeaches this guys testimony.

This is a bit bogus in my opinion. Get a social worker and ask gentle questions that don't deal with the murder. Did you see your mommy this morning? What was she wearing?

Possibly. The person that they bring in would have to be on the original list of 16 and not some other person that came forward at a later date. I find it hard to believe that the officer would lie on the stand about something so easy to verify.

Maybe she got up to go to the bathroom and saw/talked to her mom or dad, then went back to bed.

Brad had already told them that his 4 year old was asleep when her mother left to go run. I don't know that there was any reason to question a child about something she couldn't possibly have seen.

Wouldn't police know that person's name from the custody hearing and that was before he was arrested, right?

I just don't believe what a four-year-old has to say should be allowed in testimony.

Oh, yes, maybe more than a bit old-fashioned. Punch Cards, Mag Core, Paper Tapes. I am sure this rings a bell. It was SLIGHTLY before I started in computers, but only by a year or two. I cut my teeth on PDP-11/34's was around for the birth of the PC. Spent a lot of time at Radio Shack drooling over the TRS-80's... WAY out of my price though.

We'll see what she says in court now (if called).
Rest assured the cop knows now what her testimony will be.

Yes. I was making reference to the defense bringing in a witness that claims they saw Nancy and the police didn't interview them. I was saying that it had to be one of the original 16 and not somebody the defense found that came up with that information at a later date.

I remember all the witnesses in the Laci Peterson case that claimed they had seen her walking that morning. They ended up contradicting each other with where they saw her. It was determined to be impossible for her to have been in all the places they said they saw her.

This is true. First we have opinions and gossip from the neighborhood, now we have police testimony where he believes a license plate was removed because there was a loose or missing screw and a tool in another location, he believes that she was murdered in the house although there is no evidence of that ... and what else ... bunch of beliefs and opinions with nothing to support them. I have to wonder what the jury is thinking - whether they are thinking that trials and convictions are based on beliefs and opinions or whether they are going to wait for some "connect the dots" facts.
